It’s really weird that Alabama Republican officials would urge fertility clinics to resume just because the attorney general said they won’t prosecute. You don’t get a free pass, legally or morally or in terms of civic responsibility, just because an official proclaims personal nullification.
There isn’t any basis in law to ignore the court, and there is a mechanism to fix it via the legislature and that hasn’t happened. And as a practical matter, I’m sure it would violate a codicil of their liability insurance.
It’s weirdly hypocritical of the “law and order” party to simply ignore an inconvenient court decision.
Although this whole topic would make a good Law & Order viewing party.
