The reporter learned from the Sun Yang team that the Swiss lawyer team in Sun Yang informed Sun Yangfang by email that they had received the judgment of the Swiss Federal Supreme Court, and the judgment result was to revoke the previous decision of the court of arbitration for sports (CAS) concerning Sun Yang. As of press time, the Supreme Court of Switzerland and CAS have not made a formal statement. The reporter will follow up and report the progress of this matter.
Event review:
On September 4, 2018, an out-of-competition doping test was conducted in Sun Yang, and the test was not completed due to doubts about the qualification certificate presented by the inspectors. IDTM reported to FINA that "Sun Yang violently resisted the inspection", while Sun Yang said that "he fully cooperated with the inspection, but there were many illegal operations in the process".
On November 19, 2018, FINA held a hearing on this matter in Lausanne, Switzerland, and Sun Yang himself attended the hearing.
On January 3, 2019, the FINA Anti-Doping Commission ruled that the doping test conducted by IDTM was invalid, and there was no violation of the World Anti-Doping Regulations in Sun Yang, but it was not advisable to destroy the sampling.
On January 27, 2019, the British Sunday Times reported that Olympic champion Sun Yang treated drug inspectors rudely, saying that swimming Olympic champion Sun Yang had a conflict with doping inspectors, and his security guards smashed the sealed blood sample bottle with a hammer, which may face a lifelong ban.
On the afternoon of the same day, Zhang Qihuai, a lawyer from Sun Yang, issued a lawyer's statement on the matter, calling the article an untrue report and publishing some details of the incident. According to the statement, when IDTM staff conducted anti-doping inspection outside Sun Yang, there were many illegal operations in the whole inspection process.
On March 12, 2019, WADA appealed to court of arbitration for sports against FINA's ruling on doping control in Sun Yang.
On November 15, 2019, court of arbitration for sports held a public hearing in Montreux, Switzerland, to hear the appeal of WADA against Sun Yang and FINA. The hearing started at 9: 00 a.m. local time and lasted until 7: 00 p.m., and the whole process lasted more than 10 hours.
After the trial, Sun Yang spoke first, then witnesses from all sides gave testimony and accepted questions from lawyers and arbitration panel judges, and finally the parties concluded their speeches.
A month later, court of arbitration for sports announced that due to inaccurate translation and the need for both parties to provide transcripts again, the announcement of the arbitration results originally scheduled for early January would be postponed.
On February 28th this year, the arbitration result of "Sun Yang Case" was announced, and Sun Yang lost the case and was suspended for eight years. Sun Yang then appealed to the Swiss Federal Supreme Court.
