47 House Republicans vote to write same-sex marriage into law (Get $750 Now!)
In a largely nonpartisan vote that would have been impossible ten years ago, over 50 House Republicans joined all Democrats in supporting the legalization of same-sex unions on Tuesday.
As the bill passed 267-157 with 47 Republicans supporting it, including members of the GOP leadership including Conference Chair Elise Stefanik (R-N.Y.) and National Republican Campaign Committee Chair Rep. Tom Emmer, Democrats cheered vociferously from their side of the floor (R-Minn.). Republicans Steve Scalise (R-La.) and Kevin McCarthy, the minority leader, abstained.
Speaker Nancy Pelosi remarked on the floor, "This bill makes crystal clear that every spouse and their children has the fundamental freedom to take pride in their marriage and have their marriage acknowledged under the law.
State recognition of same-sex weddings was mandated by a Supreme Court decision from 2015, but Democrats pushed for the policy's codification in the wake of the court's Roe v. Wade decision last month. Justice Clarence Thomas supported the court's prior decision on same-sex marriage in a concurring opinion.
The short bill, which would overturn the 1996 Defense of Marriage Act, which defined marriage as a union between one man and one woman, faces an unclear future in the 50-50 Senate. Additionally, it would call for states to recognize same-sex unions as long as they were legal in the state in which they took place.
Many of the Republicans who voted in favor of the law are members of its more recent history. Representative Liz Cheney (R-Wyo.) and Scott Perry, chair of the House Freedom Caucus, both voted in favor (R-Pa.).
"More power to homosexual couples who wish to be as blissfully or painfully married as straight couples. I've done it more than once, so you can trust me. Following the vote, Rep. Nancy Mace (R-S.C.), another yes vote, tweeted.
Since Democratic leaders were unsure on Tuesday, it is unclear if the Senate will take up the bill. Senate Majority Whip Dick Durbin (D-Ill.) said he would personally support putting it on the floor but questioned whether there is enough time on the calendar given that the Senate is scheduled to take an extended break in two weeks and that there are two major party priorities that must be completed before then.
Chuck Schumer, the majority leader in the Senate, said on Tuesday that "we're going to look at everything we can do," but he would not confirm whether a floor vote would take place.
In recent years, attitudes against same-sex marriage have quickly changed. Republicans have mostly abandoned their vehement opposition to same-sex unions from earlier cultural conflicts. An unprecedented 71 percent of Americans approve gay marriage, according to a June Gallup poll.
