如果我拍的照片有路人，陌生人。。那我上传这张照片，这算是某种侵权吗？

    肖像权和著作权是独立的概念。使用图片时，两者同时不能侵犯。
    各国法律对照片中出现肖像时使用的限制不同。在中国大陆，按照《民法通则》的规定，商业性使用图片需要征得对方同意，而直接拍照并发布图片并不需要。但是《民法通则》的规定非常模糊，实际操作中变动比较大。
