In the NY Times today there was an article about whether Ether and XRP could be considered securities by the SEC & CFTC. The person being interviewed was Gary Gensler who was head of the CFTC (Commodity Futures Trading Commission) for 5 years. He painted a less than encouraging picture for Ether and even worse for XRP.

Mr. Gensler is set to say in a speech at M.I.T. on Monday that the second and third most widely used virtual currencies, Ether and Ripple, have most likely been issued and traded in violation of American securities regulations.

“There is a strong case for both of them — but particularly Ripple — that they are noncompliant securities,” he said in an interview. He believes Bitcoin, the original virtual currency, can remain exempt from securities regulations.

This has made me pause on buying any coin that was an ICO. My concern is that as an American if ICO coins are deemed securities how would that affect my portfolio? Even worse could I be held responsible for trading "noncompliant securities"? I think the latter is extreme, but I have to keep it in mind.

This actually made me stop from buying some EOS today. I am interested in EOS more now because of ONO, but will EOS also fall under the noncompliant securities? I know they went to great lengths to say in the white paper that the coin had no value whatsoever, but the US government could care less if it came down to it.

I think we will have some guidance once Japan issues it's ICO regulations and how it views securities. Until then, my Japanese wife who lives in Japan will have to do the buying. Fingers crossed!
