Oracle sues CryptoOracle for trademark infringement

According to the Computer Reseller News , a dispute over trademark infringement and cybersquatting has pitted the multinational Oracle Corporation against the startup CryptoOracle.

Oracle defends its brand

Oracle, the software developer based in Redwood City, California, offers popular offerings on the market, such as database management through its native blockchain, the Oracle Blockchain Platform, and cloud computing services. His most famous creation is the Java application.

Louis Kerner, a former Goldman Sachs executive, founded CryptoOracle in 2017, a multinational that works in the decentralization of cryptocurrencies and smart contracts. She made her way to the crypto-community with the Cryptomondays event.

CryptoOracle would have benefited from the reputation of the Oracle company, to build a reputation in the technology sector. However, choosing the name of its new platform is not a coincidence, given that Oracle is a leader in the technology sector.

The complainant blasted the fledgling company CryptoOracle for abusing its name "to promote Oracle's reputation as an innovator and leader in the technology industry, and to evoke among consumers the goodwill that Oracle has built in his own famous brand.

California justice takes the case

Oracle has nothing against the fact that his opponent would share the same ambitions as him to plebiscite the Blockchain. Which is not at all the case when it comes to sharing the same name in the industry.

After attempting to amicably settle the discrepancies, by sending a letter of termination and forbearance to CryptoOracle, the latter instead responded with a trademark registration application. This prompted Oracle to bring the lawsuit under the jurisdiction of the District of Northern California.

On the order of the court, CryptoOracle was asked to cancel its trademark application, as well as the use of the brand name on the web. Oracle even goes so far as to be part of the dividend allocation at CryptoOracle.
