So, what does copyright prevent you from doing? It prevents you from redistributing copyrighted material.
So, that means you can cover another bands songs. You can do this all you want. However, putting it in a video, and uploading it for many to hear, is a violation of copyright.
If you want to do a song spoof, and then have it on ThemTube, you have to go and get permission. And there are many songs already who have agreements. When you put them on ThemTube, they get a percentage of the advert revenue.
Now, ThemTube should be flagging all of those karaoke songs and covers... but, they do not have the man power. They never did. All there are is ever more sophisticated bots going after copyright infringement. Further, this is a tactic of people who "hate" you, to file copyright strikes with ThemTube to harass people.
I do not agree with Intellectual Property.
The copyright laws are waaaaaaayyyyy to far on the owners side (Thanks Mickey Hitler) and what was considered squarely in fair use now has to be argued in court (at your expense).
IP will just go away. Soon video servers and wall servers will be in everyone's homes and copyright will be impossible to enforce. (you can thank the House of Mouse again)
Disney have been responsible for extending copyright to keep the Mouse in their grasp and I think that has gone too far. Musicians have long been ripped off by the industry and now it may be even harder to make a living from music as it is so easy to obtain it for free. Maybe I should just decline rewards on my cover song videos, but I would rather direct some rewards to the artist if there was a mechanism for that. There's a dapp for someone to build.
You could put them as beneficiaries if they had accounts I suppose? Might be a difficult dapp to make considering it would involve cashing out to fiat.
I seem to remember someone trying to set up something like this a while back. It could work if there was a specific account to handle this that was trusted. If companies start seeing rewards coming from Steem then they may go investigating and send in the lawyers. It's a bit of a minefield and what I am seeing from YouTube is part of that. They have got away with it for years.
In general, I think people just need better education and better communication on this issue. A lot of people do not realize what's okay and what's not quite okay, but many will rectify their ways if they know the ropes better.
My approach is pretty basic, disclose sources where possible and let people make decisions if they want to reward the presented piece. There are many instances where people are happy to upvote reproductions of existing artwork, and if that's what people want to do with the reward pool, then so be it.
We get to choose what we reward here and that is a personal opinion. Lawyers may see it as more black and white. I have concerns that as Steem grows it will be seen as a threat by some companies.
That is too bad that they are getting all crazy like that. I fully support artists getting paid what they deserve though. You would think there would be some better over site though. I have never been able to get dtube to work consistently, so I dont really see that as a viable replacement.
