April 16th - CYA - Medical Power of Attorney Is it needed

Today I had nurse Steve come by and we had an interesting conversation. Let me start from the begging.

A couple weeks ago a man under his care died. He preformed CPR on the man. He ask the family to call 911 emergency, (ambulance). The family said NO. The man was dead ,no vital signs, and they wanted it all to end with his peaceful passing. So he called his supervising doctor who pronounced the man.
When he turned in his report his supervisor told him he violated his duty by stopping the CPR. That once he starts he cannot stop CPR unless he is relieved by the Paramedics, ambulance no matter what the family wants.

Now here is the rub and where it effects me ( my designated rep ).
Ether I state that I am a DNR (do not resuscitate ) or not. DNR, you will receive no help. Without a DNR medical personnel perform and make the decisions. There is no limiting or controlling factor for you because that right has been taken away.

Wether ambulance is called, medical procedures are performed or not or any other medical decisions are made are my sole responsibility. I do not relinquish this responsibility or take it lightly.

Stand up take responsibility . Stop passing your responsibilities off on others . There is no FREE health care. Bernie ( DNC ) told you last night that you will pay for it just not at point of receipt. People make me laugh.

I have an iron clad medical power of attorney. Months ago when I was diagnosed I went out and put all my legal matters in order. Those who have been following me have seen the posts going through that journey back then.
Get a medical power of attorney. A Will and make sure you have your wishes covered. They are not expensive $10-15 .

We all need to be prepared for and hope we never use it.
It lays out what the authority of the medical establishment is and their subordinate role. That is important to me.

It is not an expensive thing and most of the forms are on the internet. I had mine done by an attorney. Its very in-depth. That’s because of my illness.

Good advice. I have a will. I probably should do a new medical power of attorney. I don't even remember what mine says Did you feel the need to have a financial power of attorney?

I was able to get myself some life insurance but I have not made a will yet. I will have to look into it. For the medical power of attorney, I need to look into what it means if I give it to my wife.

I have two of them. One thats gives the authority and another that briefly explains my wishes.
I think every wife and husband should do it for each other.

I told my uncle this exact thing after I buried my mother. He didn’t do it, now both of his daughters, different mothers’ are bitter. It’s ugly.

Yea , thats a shame. It does rip families apart.
That all could have been avoided.

I so agree as difficult as it is for anyone to think about these matters it is far better than leaving it to the default medical protocol, which is to always try resuscitation even when doing so might cause more harm than good (for example, if a person is not likely to survive much longer and will be damaged in the process). They are not allowed to make any decision short of the maximum effort to revive someone, even in the situation you described, unless they KNOW there is a DNR (they have seen it) or a DPOA and the person delegated to make decisions is present.

Honestly I think most people in that doctor's position would have done the same, but legally they are expected to require some documentation.

They did the right thing morally, legal ,liability, not so much.

People do not realize that an older person could be killed receiving CPR. CPR is violent. Care givers are concerned about this. We’re talking about Hospice, Palliative care.
All decisions for caregivers are laid out in policies.
That is why people have to step forward and take personnel responsibilities on what they want.

The nurse covered himself by contacting the doctor and the Hospice should contact the Hospice doctor instead of harassing the nurse.

A DPOA is so important and can overrule the caregiver or police. This is where we ran into the problem. He said it didn’t. He will get it straight, I thing he is working through some things. : )

You are truly amazing- considering all the stops/corner.

In my culture, we never do this- writing of wills, making special power of attorney- preparing because, we do not feel comfortable doing that.

But you know what, I am going to take a leaf out of your book and do just that- BE PREPARED for everything/

Its uncomfortable for everyone. But it is unresponsible not to and it puts family members in a bad situation.

Yes. that is really a good "pathway." I have seen some families struggle through times like, someone getting sick or already dying and, they have more difficult time deciding on the next course of action because- they do not want to be blamed for whatever negative decision they make.

I have seen and heard of more families being ripped apart because of this. All I can say is don’t do that to your loved ones.
There is no good answers just trying to get through a bad situation.

Yes I have it all laid out.
That’s a good point. Where are your keys stored and who do they go to. Its no different then your bank account

You should write about that too its a follow up from the attorney visit to arrange everything

Yes I have a power of attorney that covers all the financial aspects.
You have to remember where I was at 7 months ago. The immediate need for all the legal preparations.
