One major factor that negatively impacts parents' struggle against CPS has been not only their uninformed/ignorant state of their rights(just as I was), but more on their slow attitude towards calling on a good juvenile dependency attorney early. Parents fail to call on a good attorney who doesn't work for the county on time, they call when they have gotten themselves already deep into the unhealthy tactics of CPS caseworkers, even more sad is that many can't even afford one.
Most cases would have been in the favor of many parents if only the situation was handled well on time. It is vital to know that a social worker's primary duty is not to help you but to prepare a 'legal case' against you.(I never knew this too back then). Every parent should store this sensitive information closest to their heart so they always remember that Social Workers ain't friends, even if they act friendly. This makes sense why CPS wins easily over parents with insufficient funds; They are unable to get an attorney to work on their case on time because they can't afford it and then they are left at the mercy of a two-sided court appointed overworked piece of a lawyer.(We got one too!, I felt disgusted by lawyers afterwards).
Parents need to get their attorneys on board from the very start if they can afford one, this will straighten out and prevent so many crafty walk by social workers. The evidence a caseworker collects are not provided when they were called, because most of the tips that get them to your door mat are not 'probable cause' to remove a child. They get every possible evidences from your communication with them, from every word you say, from what they see when they walk into your home, little things that do not really matter, every piece of information goes into their report! except for the fact that they report them in incriminating style. A style that makes you seem like the worst parent in the world, when all you have done all your life is love your kids.
DON'T ACT WHEN IT IS ALREADY TOO LATE. Delete lateness from your dictionary
Like I have said, information are reported out of contest, and lies and more lies are imputed. You wont be aware of all this, but they have built up a case against you to enable your prosecution in court. That is why you need your attorney from the onset , time matters the most when dealing with these type of people. A huge percentage of the cases handled from the beginning with a sound lawyer resulted in CPS backing out, because they end up not being able to lie when they make a report nor report out of context since your attorney is there to make sure the information are interpreted and written exactly as you meant. They know how to handle caseworkers since they are familiar with the whole process and know when a caseworker is trying to be deviously smart, it is their specialty to know all these.
I know many many parents will be incapable of having a lawyer on time because of financial restraint, but I want to say that there is somebody that is far better than a lawyer in the onset of a case, and that person is "YOU". An informed YOU, who knows his right fully to stop a case worker in its early stage. They would know you are not so much of an easy target and will initially back down. During the time they back down, you would be busy building up your family protection and trying to get the legal independent aid you need if they ever step onto your door mat again.
Remember it is your Legal Right to tell a social worker that you need time researching your rights before you can attend to them. More sternly but with a gentle spirit, let them know you can't have anything to do with them without a warrant. Talk less and let them be the one that spill in anger. You do not have any business with them if they have no legal permit to interact with you. Final.. Be a Professional Dad and Mum, you can't afford to be a dummy.
