Two teens charged in fire that destroyed Bush’s Chicken restaurant

ACO, Texas (KWTX) Two Central Texas men have been arrested and charged in connection with the fire that destroyed Bush's Chicken in China Spring on March 8.

Tuesday, McLennan County Sheriff Office Sgt. Brad Bond, one of two trained department arson investigators, confirmed the arrests of John Ryder Whited, 19, and Kolby Jordan Cagle, 17.

They were taken into custody several weeks ago.

Whited was charged with arson, burglary and tampering with evidence.

He’s free on bonds totaling $20,000.

Cagle was charged with tampering with evidence and is free on an $8,000 bond.

Bond says evidence of an accelerant was found after the fire.

"Those materials were sent off to the crime lab and later came back testing about positive for gasoline,” he said.

But a tip that led to the arrests.

"I received some information from a confidential informant that they knew about the person who may have been involved in this fire,” he said.

According to the complaints filed against the pair, the two teenagers broke into the restaurant with the intention of stealing money from the safe.

But one of the two cut his hand while breaking out a window, Bond said and “got scared that we would be able to track his DNA from the blood left behind went back and burned it to try to cover up the evidence,” he said.

"They stripped off their clothes and shoes and threw them into a fire in an attempt to destroy their evidentiary value,” the complaint says.

Cagle was an employee of the restaurant, Bond said.

Whited, was living at Texas State Technical College at the time and had worked earlier at Bush’s, Bond said.

The restaurant’s longtime owner, Dianna Guerrero, said Tuesday she plans to rebuild.
