The concept of plagiarism consists of taking someone else's work or creation and passing it off as your own, without proving the original source or directly hiding it. It is a behavior usually associated with people who are either ignorant of what they are doing, or are counterfeiters trying to get something; recognition, satisfaction, or even money.
We all agree that plagiarism is morally wrong, and there have even been lawsuits and lawsuits about it, as it is a crime in many countries. However, the thing is not as simple as it seems at first glance. By this I do not mean that it is justified, but to clarify my point I am going to introduce an extra concept: 'Fair Use'.
Fair use is a doctrine in the law of the United States that permits limited use of copyrighted material without having to first acquire permission from the copyright holder.

However, this definition will seem ambiguous to many people, and with good reason, since this concept was created by lawyers and judges for that purpose; that has multiple interpretations and extensions of meaning. In this way, the responsibility of deciding whether the use of the work is legitimate or not is shared between the creator of the original work, the creator who "copies" it, and the lawyers of each one.
This is intimidating, as the use of other people's works (even with good intentions) ends up being like walking a tightrope between right and wrong. However, judges in the United States consider four criteria to decide what use is legitimate. These criteria are presented below:
"1. The nature of the use , including whether use is commercial in nature
Courts often focus on whether the use is "transformative," that is, adding a new expression or new meaning to the original, or simply copying it.
The protected work's nature
If material from works based primarily on real events is used, the use is more likely to be considered legitimate than if purely fictional works are used.The relevance and amount of the fragment used in relation to the whole of the copyrighted work.
Of these four, the criterion that concerns us the most and on which I am going to focus is the first. It stipulates that the nature (commercial or not) of the use of the work is considered, as well as its transformation (this is what we referred to earlier with making comments, criticisms or parodies). A use of the work that generates a monetary remuneration or is directly a 'copy and paste', without changing or adding any element or new perspective, would not meet the first requirement of Legitimate Use.
This is where we finally come to Steemit. While it is true that many users use this platform as a way to have fun or share our interests and passions with similar communities, it is also true that income can be generated with our activity. Therefore and from my point of view, it would not meet the first requirement of Fair Use, since it is unfair to generate income from a work to which we have no right or merit.
This is why we must be very careful with the use and mentions of other people's works in our posts on the platform. It is our responsibility as Steemit users to give credits and place references throughout our stay.
I want to emphasize that although the conclusion of my post has been based on the first criterion, I strongly recommend taking into account all four in their entirety. Just to make sure we are as fair as possible, both to the authors and to ourselves.
