Hello my steemian friends! Hopefully a you all will befine. Today I am here for participating in SLC-S22/Wk2 with the aim for getting some knowledge about law. The topic is Branches of Law and the teachers of this course are @anasuleidy and @elider. So get started;

Part I

Public Laws in Pakistan:

Public laws are those which govern the relationship between the government and individuals or organizations (mean public). Examples of public laws are constitutional law, administrative law etc.
In public laws we will discuss about constitution pf Pakistan and Election law.

Constitution of Pakistan:

The Constitution of 1973 is a constitution of Pakistan which is also called supreme law of the Pakistani nation. This constitution explains the government formation in my country. In this constitution different aspects are cleary written including principles of democracy as well as the independence of judiciary, fundamental rights and the separation of power in the different arms of the government. Since it is the highest/supreme law in the country that is why it comes under public law as it affects the relation between the government and the people. Beside this this law controls the operations of governmental departments. This supreme law determines the connection between state and individual citizen as well as the rights of citizens, duties, state powers and responsibilities on one hand. In short it covers all aspects that is why called the supreme law.

2. Election Laws:

Different elections are held in my country for issuing differents goverments like general elections are common. And for dealing the fairs of these elections it is necessary to be done under laws. Elections in Pakistan are held by rules and legal procedures in the Pakistan to conduct and organize the election clearly and honestly. These are defined in the Representation of People’s Act 2017 and the Elections Act, 2017. These laws simply assure the requisites of a candidate, the manner of completing polling process and the authority given to the Election Commission of Pakistan (ECP). These are called election laws and are included in public laws as they assure the selection process of next government by public. In that they concern the exercise of state power and followed by systematic political influence on the given country. Secondly, these laws rightly look after the free and fair polling or selection of elections in the country because this is very important to maintaining the democracy in the country.

Private Laws in Pakistan:

Private laws are those which deal with relationships between private individuals such as major contracts, property law, family law and tort law.
Here we are going to discuss contract law and property law as private lawa.

Contract Law:

Contract Act, (1872) defines the law of different kind of contracts in Pakistan
This also contain rules related to formation, discharge and enforcement of contract between two parties so that both parties can be prevented from any kind of conflict. The contract law belongs to private law which mean it defines the relationships in a legal way between private people. And main point of this law is that it does not has any reference to the law between these individuals and the state. This law has its own legal basis and has a great contribution within business, commerce and economic development.

2. Property Law:

The Pakistan property law was applied specificaly with the Specific Relief Act, 1877 and defines the rules and regulations about property and land dealings in my country. It tells us or we say bound us about ownership, possession and use of property and other legal obligations of persons as they exist regarding to his land or property. Property law are included in private law of Pakistan since it deals with rights or obligations of the two or more persons in different fairs related to property such as relation between buyers and sellers. It bound us to property dealings and using its rules we can easily solve our issues regarding to possession, selling or buying.

So the Public law in my country refers the laws that address the intra and inter relationships between the government and the public. In contrast, the Private law in Pakistan are those that may be brought by an individual person or two or more persons. These laws regulate commerce, transactions, possession and use of property. Within the society they contribute in creating and developing the society.

Part II

Administrative Law is my favourite law

Although all laws are issued for the well being of people but from all these branches of law, I find interest in Administrative Law. The reason is that this law provides a fast way of getting our right or fulfilling justice. Morever, Administrative Law protects the freedom of its people by making some decisions under regulations by using executive power.

Administrative Law deal with the behaviours of all executive powers, as well as its main focus at their functions, processes and actions. Administerative Law is a very important law because it is tells us the rules through which we can resolve the dispute between citizen and the administration. Furthermore, the subject of Administrative Law enables the us to question the decisions made by these agencies, so that we can protect our right and freedom. This law is responsible for peace and duties within the government practice lawful conduct.

Administrative law applied with many beneficial points like it restrict that how the government work and it help to keep a check on the government’s actions and performance. This law decreases the risks to the individual and the business and create a more suitable environment for the economic development and growth. In completingg this role, Administrative Law claims that decisions made by government agencies, can be questioned by people. In addtion, this law increases the validity of the public trust towards the government and the society in generally is more transparent and democratic.

Part III

My contact with Administrative Law

Personally I have not any contact with Administrative Law directly but it happened several years back when I studied in 10th class in Govt. High school chorasta, Punjab. My uncle who was a teacher at that school faced some issue from the Head of institute. Due to some personal issues with my uncle, the head took advantage of his authority and wrote an application against my uncle. The head claimd that he is not performing his duties well. Hence he was a very good teacher in his career.

We knew that things were not going well one day when we got a investigation letter from a government higher department of educatio informing us the complain and ask for retirement. We had no option but to consult a lawful attorney who had experience in Administrative Law. But, all of them said that they can do nothing for us; after examining our case, the lawyer told us that we have the right to appeal against the decision and to conduct a hearing before the administrative tribunal. The lawyer guided us the legal way to solve this issue and also it is our belief that we have acted legally and it is for this reason that we brought forward our side of the story including evidence and witness to prove the point.

After several months of waiting, the administrative authorities made it’s judgement. On our side we noted that the tribunal correctly declared that the government department and head had improper evidences against my uncle. The tribunal directed the government agency to restore the teaching career of my uncle.

In conclusion the Administrative Law, is very functional branch of law designed to test desputes, improper and injustice in government’s decisions. It is an efficient and equal way to address the people’s complaints against state and protection of the people’s rights. My uncle used Administrative Law and finally he completed his career years until his retirement.
