When talking about laws and rights in my country, all people think is that it is messed up and it is fully corrupt, when you're a violate the right you will know how intact and functional these rights are. In my state, I have heard of many violations of these rights and happily the violators have been called to face the law.
I really loved the Human rights topic in my civic education class, it exposed us to many things we didn't know and we knew more about our rights as citizens of our country.
-. Based on what was explained in class, state in your own words and with explanations whether you consider that human rights are respected or violated in your country.
This is not hidden anymore as the system in my country is corrupt. The human rights in my country is respected in many popular cases, which people always follow up to know the root of the matter and to come clear, in most cases the violators face the law.
Some of the systems who were to enforce these rights and laws are now going on to break them. The police mostly violated the young people's life. Everytime I use the road, many vehicles are being stopped and any guy that dresses nicely will be held, searched thoroughly and pressured to go on with money transfers with an allegation that he is an Internet fraudster. This now is a violation of the third generation our human rights as listed by our teacher, Right to protection of personal Data.
Another violation is the right to life, many people in the country are not enjoying their right to life as they are being pressured every moment, kidnappers, robbers and bandits have all caused troubles to a person's right to life and most times the forces can't do anything about it.
Looking at the bokoharams, a notorious bandit group in my country have been terrorizing the people there by kidnapping the residents, destroying their properties and killing their family members, this is a violation to their rights in the country.
The rights in my country are mostly violated rather than respected in my country.
Please state, according to the laws of your country, whether Human Rights have the same value as the Constitution of your country, whether they are supra-constitutional, or whether the Constitution prevails over international treaties on Human Rights.
In Nigeria, the constitution of the federal Republic is more superior and prevails over the international Human rights treaties. The Nigerian Constitution which was enacted on May 29 1999 is the law of the country, which means it over thrones any other law.
The Constitution has given everyone full obligation to exercise these rights. The Constitution is divided into several chapters and chapter 2 of talks about the fundamental human rights, which guarantees that every citizen living in the country can exercise their rights, like; right to life, right to join any association or assembly, right to freedom of speech, and also protection from discrimination. All these shows that the constitution and human rights has the same values and goals.
mention any organisation in your region that has jurisdiction over human rights. In your opinion, how useful it has been and how its operation has influenced respect for human rights in your country.
In Nigeria there are many organization that has that jurisdiction over human rights, and they're;
• National Human Rights Commission: This organization has been very useful over the years when it comes to human rights, it has had a huge influence and it respect human rights in the country. They have major functions in the state and the core main functions are;
- Monitoring Human rights
- Investigating complaints
- Promoting human rights
The organization has been very useful, as it has given people whose rights were abused the chance to seek for justice, it also creates awareness about the rights, many people don't know about their rights as citizens and they let people trample on them, this organization brings about awareness towards these rights.
Other organizations include;
- National assembly's committee on human rights
- Ministry of justice human rights department
- Human rights watch.
Have you or someone close to you been a victim of human rights violations? If so, what was the situation and were you able to assert your rights?
Some people in the forces have brought a bad name to the entire force, you're not given the opportunity to exercise your right even when you know them. I think this introvert life I'm living has saved me a bit.
One of my coursemate was on his way to see someone, he has his hair locked like dreads, and he dresses nicely. He went boarding a bus with other passengers and the bus was stopped by the police, they looked inside as though they were searching for criminals and unluckily for him, he was called out and these men asked the bus to leave.
The went through his phone, going through his personal data as though he was accused of guilty of a crime, this which his right to protection of personal data has been bridged. While searching and they found nothing on him, they asked him for a tip which he said he doesn't have, they threatened to take him to jail and they openly told him that he will pay enough, before he will be released.
He had no other option that to give them a tip and leave, there's no time to assert your right with them, even if you report the case might just fade off. It will be nice if you're s public figure then your case will be well handled.
CASE STUDY 1: Please state whether you believe that the human rights of the victim in this case were indeed violated and whether the complaint to the aforementioned body should be admitted or not. Explain your answers.
The son was the victim of this violation to right to life and not the mother, it is always direct to the victim although it might cause other harms to the family but they can always seek for justice if it stands right. The rights of this victims were not violated because he was killed by assailants and not the state or a kind of law. So the law came in and did their jobs by prosecuting this assailants which is their work.
The mother calling for justice for violation to her right to life in this case is not supported by the inter-American commission on Human rights, they would have come in if the states violated the rights, but in this case they didn't.
CASE 11: Please state whether you believe that the human rights of both the victim and his/her family are being violated. Explain your answers.
In this case, the person's right to life has been violated, as he was beaten up in a protest ground to death by officers of the law. In the international Human rights, everyone has the right to life and this right his own right was violated.
The family now jumping in to seek for justice but the investigation team now comes up that the case died long ago is another violation of the right to justice, which the family were seeking justice to the life of their child.
