訴訟はリップル、子会社のXRPⅡ、リップル社のCEOに対して行われ、「リップル社のXRPトークンの販売は、米国証券法を違反している」と主張している。

個人の原告であるライアン・コフィー氏は1/5に650XRPを購入、1/18にUSDTに交換、その後USDと交換し、約30％の損失を受けた。

XRPに対する好意的な記事のリツイートやCEOの仮想通貨会議への出席などXRPに対するリップルラボ社の宣伝手法に原告は損失を受けることを予期できなかったという点が今回の訴訟の主なポイント。

リップル社の広報担当者は以下のように回答をしている。

「我々は弁護士のツイートを見たが、訴状を受け取ってはいない。主張の法的根拠の有無を適時判断する。ＸＲＰが証券かどうかはSEC（米証券取引委員会）が決めること。我々はＸＲＰが証券と見なされるべきではないという考えは変わらない。」

XRPは、CFTCの元会長・ゲリー氏が「有価証券に分類される可能性がある」と発言し、話題になっていた。
XRPが有価証券に分類された場合、SECの認可を受けている取引所でしか扱うことしかできなくなるため、アメリカでは取引することができなくなる可能性も。

証券に分類されるかどうかはXRPの価格にも大きな影響を与えることががんがえられるため、今後の動向には注視していきたい。
