Kenya Nullifies Presidential Election. A First in Africa and Third in The World.

On the 1st of September Kenya became the very first country in Africa to ever nullify an election after a Presidential Petition was launched by the losing Presidential candidate in the highest court.

The Supreme court declared the it was satisfied that the election was not carried out according to the Constitutional provisions and that irregularities and illegalities had been committed.

Although the court did not submit a wholesome ruling, the judges cited time constraints and offered to submit the entire ruling and their reasons at a later time.

The supporters of the winning candidate, I included, were shocked at the ruling. In the entire petition there was no evidence at all that indicate that the integrity of the election process had been compromised.

The petitioners had focused solely on the electronic transmission of polling data as the reason why the presidential election should be nullified yet that was not the data which was considered while computing the final tally.

The ruling was seen as a political one since the opposition had threatened mass action and violence if the judgment went against them.

It is also expected that the judgment has opened up a can of worms, since it lowered the threshold of evidence, therefore allowing election losers to submit petitions from Governors, Mps and Senators. It has already started happening.

The country is expected to hold another Presidential Election within 60 days.
