Ultimately, the Tunisian Labor Code represents an essential pillar in the protection of workers' rights and in the regulation of professional relations in Tunisia, although it requires reforms to better respond to contemporary challenges, these improvements could include an adaptation to new economic dynamics, an extension of protections to independent and informal workers, as well as a strengthening of inspection and control mechanisms to guarantee effective application of the rights provided for by law, while promoting a work climate more inclusive and equitable for all.

In Tunisia, several institutions play a fundamental role in the protection of workers' rights, thus guaranteeing effective application of the provisions provided for by the Tunisian Labor Code and other legal texts relating to employment, among them, the employment courts occupy a central place, since they are specialized in resolving disputes that arise between employers and employees, whether disputes related to employment contracts, unfair dismissals , non-payment of benefits social or other violations of workers' rights, these courts function as impartial arbiters, providing a legal avenue for workers to obtain justice and redress.

In addition, the Labor Inspection constitutes another essential actor, whose main mission is to monitor the application of labor legislation in all companies, public or private, this institution ensures compliance with standards relating to working conditions, such as legal working hours, safety in the workplace and respect for the social rights of employees, in the event of conflict or non-compliance, the Labor Inspectorate can intervene directly in mediation or transmit the matter to the competent courts, it also plays a role preventative by organizing awareness campaigns to inform employers and employees of their rights and duties.

The intervention of the Labor Inspectorate was decisive, because it made it possible to establish the facts and remind the educational establishment of its legal obligations towards its employees, after a thorough investigation, the inspectors confirmed that the dismissal was not was not justified by valid economic reasons and that it violated my colleague's rights as a worker, based on this observation, the case was brought before a labor court, where my colleague, assisted of a lawyer, was able to present all evidence of his case, including testimonies and documents demonstrating the lack of real justification for his dismissal.

Finally, thanks to the legal procedure and the support of the competent institutions, the court ruled in favor of my colleague, recognizing the unfair nature of the dismissal and ordering the establishment to pay him fair financial compensation for the damage suffered, this experience highlighted the importance of knowing your rights and using the institutions provided to defend social justice, while showing that even in the face of powerful employers, it is possible to obtain redress when the law is applied in a manner rigorous.

Part III

Practical Case 1

According to what was seen in class, and if you were a lawyer who had to attend to these workers, what principles of those explained in class would you apply to the present case?

In this case, it is evident that the employer deliberately sought to circumvent legal obligations by establishing contracts that mask the true nature of the work carried out by employees, while introducing clauses that violate their fundamental rights, according to the principle of reality over forms or appearances (Article 18.3), it is imperative to favor facts over contractual form, because although the employees are officially qualified as "cleaning personnel", their real work consists of driving trucks as drivers, this principle establishes that the true function performed by workers must take precedence over the misleading descriptions included in contracts.

The principle of intangibility and progressiveness of rights (Article 18.2) reinforces the idea that workers' rights, such as social benefits and job security, cannot be diminished or canceled by agreements between employers and employees, even if the latter accept them under economic duress, any attempt to degrade these rights is illegal, because they are protected by legal norms which take precedence over any individual contract, therefore, the clauses of the contract which stipulate that the employees renunciation of their social benefits and their liquidation are not only unacceptable, but also void under the law.

Finally, the principle of nullity of agreements contrary to workers' rights (Article 18.4) clearly stipulates that any clause or agreement implying the waiver of fundamental rights is null and void, in this case, the agreement according to which the workers will not be able to claim their social benefits or their liquidation is legally invalid, as an employee lawyer I would rely on these principles to request the reclassification of the contracts, demanding that they be recognized as drivers and not as cleaning staff.

I would also plead for a retroactive calculation of their social benefits and compensation for the damages suffered, emphasizing that these contractual practices seriously violate legal provisions and the fundamental principles of labor law, this approach would make it possible to restore their rights and guarantee application strict compliance with the law to avoid such abuses in the future.

Practical Case 2

Based on what you have seen in class and according to the laws of your country, state which institution this worker should go to and what actions he should take to restore his rights.

In a case where a worker, having accumulated fifteen years of seniority within the same company and finding himself dismissed for reasons considered questionable, wishes to assert his rights and contest the employer's decision, the first step consists of send to the Labor Inspectorate or the equivalent institution competent in your country, because this entity is responsible for ensuring the strict application of the legislation in force and for coming to the aid of employees who believe that their rights have been violated.

To do this, the worker must first file a formal complaint or a detailed complaint, setting out precisely the reasons for his dismissal and highlighting any possible violations of the legal procedure, such as the absence of a legitimate reason or non-observance of the rules relating to notice, following this first step, the Labor Inspectorate may open an investigation in order to establish the regularity or irregularity of the dismissal, resort to mediation in order to reach an agreement amicable between both parties (for example, the reinstatement of the employee or the payment of compensation), or, if the situation requires it, giving the employee the possibility of going to an employment tribunal to assert their rights in a more formal and binding manner.
