From the authors interview with the informants of the research, the authors conclude there are some things that become obstacles in the management of wakaf land certificates, so the land of wakaf in Gampong Beuringen District Meurah Mulia so that there is no single wakaf land that has a certificate, namely:

Reluctance of Heirs and Nazhir Taking Care of Wakaf Land Certificate

From the interview result of the writer, it can be understood that one of the constraints in the management of wakaf land certificate in Gampong Beuringen Kecamatan Meurah Mulia is due to the reluctance of heirs in the certificate handling. As stated by Mr. M. Kasem as the son of Alm. Tgk Isaac who inaugurated his land for the expansion of Gampong Beuringen's public grave. Mr. M. Kasem said that the certification process has become the responsibility of nazhir who has been given trust to the land of waqf. In addition Mr. M. Kasem as heir also argues that the wakaf land does not belong to the heirs anymore. Therefore, in the handling of the certificate is not our obligation but the obligations of people who have been given the trust of our parents.
The willingness to take care of wakaf land certificate was also submitted by Mr. Zainal Abidin as the secretary of Gampong Beuringen. According to him, for the land represented by Alm. Tgk Ishak for the expansion of Gampong's public cemetery is no longer taken care of the wakaf certificate because the land already has a certificate of awakening (AIW) issued by the Office of Religious Affairs (KUA) Meurah Mulia Subdistrict so that it is deemed sufficient as evidence of the land wakaf land. According to him, the possibility of the occurrence of problems or disputes over the land is relatively small because the cemetery is not high economic value.

1. Understanding That Deed of Waqf Allegiance (AIW) is Sufficient

In addition to constrained by the reluctance of heirs and nazhir from wakaf land to take care of wakaf certificates, other constraints in the implementation of wakaf land certification so nazhir not yet take care of wakaf land certificate is the understanding or assumption that with the Deed Achievement Pledge (AIW) issued by the Office of Religious Affairs Meurah Mulia is adequate for legal protection in the event of a dispute. This was stated by Mr. Abdullah, one of the members of tuha peut Gampong Beuringen, Meurah Mulia Sub-district, related to the certificate for cemetery land which is a wakaf land belonging to Gampong, according to him the land has been agreed not to be certified because it already has Deed of Wakaf (AWW) no longer need to take care of the certificate, because the Deed of Waqf Allegiance is also a strong proof that the land has been reproduced.

1. Certificate handling fee

The cost of handling the certificate is also a constraint so that the certificate of wakaf land is not taken care in Gampong Beuringen Kecamatan Meurah Mulia. As the acknowledgment of Tgk. M. Ali as the leader of Nurussalam Recitation Center, where there are residents who inaugurate his land for the expansion of Pengajian Center which he leads. The cost difficulties resulted in him choosing to leave the wakaf land that had been handed over and entrusted to him by the wakif without a certificate, because to take care of the wakaf land certificate must pay a considerable amount of money to implement it also through a slightly longer process. Although this resulted in the absence of an official letter of authentic evidence of the waqf, he argued that it was important that the representation of the land be legally valid, irrespective of the legitimacy of the state administration. According to him, although there are free certificate programs, in reality still require administrative, transportation and other operational costs for officers who will come to the field to measure back the land.

1. Lack of Information and Socialization of Wakaf Land Certificate Management Procedures

Information and socialization of a regulation or policy is absolutely necessary for the success of the regulation or policy, as well as information and socialization on the mechanisms and technical guidelines for the handling of land titles of waqf land in the Office of the National Land Agency.
Based on interviews the author of the lack of information and socialization about it can be felt from the incomprehensible Geuchik and Gampong apparatus and the general public in Gampong Beuringen District Meurah Mulia, the mechanism of handling Wakaf Deed Achievement and wakaf land certificate is only known by Imum Gampong and Imum Chik Masjid who often come Office of Religious Affairs for various purposes. According to Geuchik Gampong Beuringen, until now there has been no socialization of procedures for handling land certificate of wakaf especially for the Gampong apparatus in Meurah Mulia District.

Kendala Dalam Pengurusan Sertifikat Tanah Wakaf di Gampong Beuringen Kecamatan Meurah Mulia

Dari hasil wawancara penulis dengan para informan penelitian, dapat penulis simpulkan ada beberapa hal yang menjadi kendala dalam pengurusan sertifikat tanah wakaf, sehingga tanah wakaf di Gampong Beuringen Kecamatan Meurah Mulia sehingga belum ada satupun tanah wakaf yang memiliki sertifikat, yaitu :

Keengganan Ahli Waris dan Nazhir Mengurus Sertifikat Tanah Wakaf

Dari hasil wawancara penulis, dapat dipahami bahwa salah satu kendala dalam pengurusan sertifikat tanah wakaf di Gampong Beuringen Kecamatan Meurah Mulia adalah karena enggannya ahli waris dalam pengurusan sertifikat. Sebagaimana disampaikan oleh Bapak M. Kasem selaku anak dari Alm. Tgk Ishak yang mewakafkan tanahnya untuk perluasan kuburan umum Gampong Beuringen. Bapak M. Kasem mengatakan bahwa proses sertifikasi sudah menjadi tanggungan nazhir yang sudah diberi kepercayaan terhadap tanah wakaf. Selain itu bapak M. Kasem selaku ahli waris juga berpendapat bahwa tanah wakaf tersebut bukan milik ahli waris lagi. Oleh karena itu dalam pengurusan sertifikat bukan kewajiban kami akan tetapi kewajiban orang yang sudah diberi amanat wakaf dari orang tua kami.
Keenggganan mengurus sertifikat tanah wakaf juga disampaikan oleh Bapak Zainal Abidin selaku sekretaris Gampong Beuringen. Menurut beliau, untuk tanah yang diwakafkan oleh Alm. Tgk Ishak untuk perluasan kuburan umum Gampong tidak lagi diurus sertifikat wakafnya karena tanah tersebut telah memiliki akta ikrar wakaf (AIW) yang dikeluarkan oleh Kantor Urusan Agama (KUA) Kecamatan Meurah Mulia sehingga dirasa telah cukup sebagai bukti tanah tersebut tanah wakaf. Menurut beliau, kemungkinan terjadinya permasalahan atau sengketa terhadap tanah tersebut relatif kecil karena tanah kuburan tidak bernilai ekonomi tinggi.

1. Pemahaman Bahwa Akta Ikrar Wakaf (AIW) Sudah Memadai

Selain terkendala dengan keengganan ahli waris maupun nazhir dari tanah wakaf untuk mengurus sertifikat wakaf, kendala lainnya dalam pelaksanaan sertifikasi tanah wakaf sehingga nazhir belum mengurus sertifikat tanah wakaf adalah pemahaman atau anggapan bahwa dengan adanya Akta Ikrar Wakaf (AIW) yang dikeluarkan oleh Kantor Urusan Agama Kecamatan Meurah Mulia sudah memadai untuk perlindungan hukum apabila terjadi sengketa. Hal tersebut disampaikan oleh Bapak Abdullah, salah satu anggota tuha peut Gampong Beuringen Kecamatan Meurah Mulia terkait belum diurusnya sertifikat untuk tanah kuburan yang merupakan tanah wakaf milik Gampong, menurut beliau tanah tersebut telah disepakati tidak diurus sertifikatnya karena telah memiliki Akta Ikrar Wakaf (AIW) sehingga tidak perlu lagi diurus sertifikatnya, karena Akta Ikrar Wakaf juga merupakan bukti kuat tanah tersebut telah diwakafkan.

1. Biaya Pengurusan Sertifikat

Biaya pengurusan sertifikat juga menjadi kendala sehingga sertifikat tanah wakaf tidak diurus di Gampong Beuringen Kecamatan Meurah Mulia. Sebagaimana pengakuan Tgk. M. Ali selaku pimpinan Balai Pengajian Nurussalam, dimana ada warga yang mewakafkan tanahnya untuk perluasan Balai Pengajian yang beliau pimpin. Kesulitan biaya membuat beliau memilih membiarkan tanah wakaf yang telah diserahkan dan dipercayakan kepadanya oleh pihak wakif tanpa sertifikat, karena untuk mengurus sertifikat tanah wakaf harus mengeluarkan biaya yang lumayan banyak untuk melaksanakannya juga melalui proses yang sedikit lama. Meskipun hal tersebut berakibat tidak adanya surat resmi bukti otentik wakaf tersebut, menurut beliau yang penting adalah bahwa perwakafan tanah tersebut telah sah secara hukum agama, tanpa mempedulikan keabsahan secara administrasi negara. Menurut beliau, walaupun ada program sertifikat gratis, dalam kenyataannya tetap membutuhkan biaya adminitrasi, transportasi dan operasional lainnya bagi petugas yang akan datang ke lapangan untuk mengukur kembali tanah tersebut.

1. Kurangnya Informasi dan Sosialisasi Prosedur Pengurusan Sertifikat Tanah Wakaf

Informasi dan sosialisasi dari sebuah peraturan atau kebijakan mutlak diperlukan demi keberhasilan peraturan atau kebijakan tersebut, begitu juga informasi dan sosialisasi tentang mekanisme dan petunjuk teknis tata cara pengurusan sertifikat tanah wakaf pada Kantor Badan Pertanahan Nasional.

Berdasarkan wawancara penulis kurangnya informasi dan sosialisasi tentang hal tersebut dapat dirasakan dari ketidakpahaman Geuchik dan aparatur Gampong dan masyarakat secara umum di Gampong Beuringen Kecamatan Meurah Mulia, mekanisme pengurusan Akta Ikrar Wakaf dan sertifikat tanah wakaf hanya diketahui oleh Imum Gampong dan Imum Chik Masjid yang sering mendatangi Kantor Urusan Agama untuk berbagai keperluan. Menurut Geuchik Gampong Beuringen, sampai sekarang belum pernah diadakan sosialisasi prosedur pengurusan sertifikat tanah wakaf khususnya bagi aparatur Gampong yang ada di Kecamatan Meurah Mulia.
