Dilema ITE's 'Rubber' Law

ITE Law is a law that regulates information and electronic transactions, or information technology. In Article 27 paragraph 3 of the ITE Law, it states that it prohibits anyone intentionally and without rights to distribute and / or transmit and / or make access to Electronic Information and / or Electronic Documents that have content of insult and / or defamation. "

The advancement of information technology makes everyone have very broad access to social media. Through the YouTube platform, video blog is being spread in the country. Starting a lot of new popping youtuber every day.
There are two examples of cases relating to the use of the ITE Law through the recent video blog that is the case of "salted fish" by Galih Ginanjar to the case of Garuda's reporting to the Youtuber RIus Vernandes.
Many agree and disagree in the use of the ITE Law, some say that Indonesia needs that article to guarantee recognition and respect for the rights and freedoms of others in the use of information technology and electronic transactions, on the other hand it says that this law is easy to attack other people without understanding right about the direction of the article.

Based from two examples of cases, the first case of "salted fish". In my opinion, the ITE law is right on target because the disseminated content smells immoral and the victims feel disadvantaged by the statement. Another example is the case of the Garuda report to Rius Youtuber, in my opinion it is quite excessive. Maybe at that time the airline was having problems. So the list of menus was written on a piece of paper and handwritten. As a youtuber, Rius reviews whatever happens to the conditions he is experiencing. The airline claims this is defamation, isn't the fact that there is a paper that says the menu as mentioned? I really don't understand how the airline is managing. However, as a layman in my opinion, the use of ITE laws is not right on target.

In my opinion, the ITE Law cannot be abolished. It's just that it does require an effort to provide understanding to the community or it may require revisions to be able to detail the problem so that this article is not referred to as the "rubber" article and is used arbitrarily. In addition, revisions are needed so as not to create a dualism of concepts that can be used by irresponsible parties.
