I never thought the Raiders would would be on my radar this often. I especially didn't expect there to be a potential First Amendment issue coming from that team; but, the Raiders have released Damon Arnette and this could be another legal issue for the former player.
So, from what I've been able to gather, Arnette was responding to an online troll, who seems to be a minor, who was attacking Arnette for being *trash" on the field.
Arnette, rather than doing what adults do and ignoring the kid, blocking the kid, etc., decided to send his address to the kid followed with a direct video message over Instagram of him brandishing a gun, calling the kid out by name, saying that the kid is five minutes away, and repeating "If you roll up on me, I'll kill you."
Now, from a moral, ethical, and human decency perspective, Arnette was wrong and stupid at every level. The legal issue is more nuanced so far as I can tell. The words "If you roll up on me" helps him a bit in that it implies that he would only act violently if the kid trespassed or otherwise violated his rights.
Still, Arnette willfully gave the kid his address, reminded the kid that he had at least some idea where he lives, mentioned his name, and brandished a gun. If "If you roll up on me" were changed to "I know where you live" that could seriously be a legal issue and attributed to a direct, credible, and immanent threat of violence.
It seems like most of the components are there. "I know who you are." "I know where you live." "I have the gun." "I'll fucking kill you."
That's something that should be taken seriously.
