Not over.

His rationale for having the authority was based on the HEROES Act.

It was written after 9-11 to give certain emergency powers for the President in times of war, but it was written to say national emergency, and Biden claims that (because COVID) is what gives him the authority to do this absent Congress.

The only thing stopping this from ending now, is finding someone with standing, because it wouldn't survive a court challenge if it can get there and he knows it.

Defense spending is set and authorized by Congress, the branch constitutionally tasked with the power of the purse.

The claim his opposition focused on the pricetag are making is not that it's one of the largest bits of the budget, rather than somewhere along the lines of NASA or the department of transportation or something...

The claim is that it's the most expensive executive action in US history. I'm not sure that claim is entirely true, but that's better context to view it in.

And if this is allowed to stand somehow or survive a legal challenge, if it truly is "the most expensive executive action in US history" (or at least the most expensive executive action in US history not directly related to the conduct of a war)...

It won't be for long once the precedent is set.
