Crony Statism, Dewine's Dare, ORC 9.67, ICC, Persephone's Seed, Save The Crew Soccer Team: Circus n' Parade's Why Ohioans Still in Cages for Nonviolent Conduct

Got some good slop for you today. Who don't like Circus n' Parades. Today we report on how leading Republican and Democratic Gubernatorial Candidates in Ohio are angling to utilize the coercive apparatus to prevent the Columbus Crew Soccer team from leaving Ohio for Austin Texas. Ohio Attorney General Mike Dewine, and I believe candidate for Republican Gubernatorial Nomination, has activated ORC 9.67 via a suit to utilize the coercive apparatus of the state of Ohio to prevent a team move. The Columbus Dispatch paper below claims Democratic candidate for Gubernatorial Nomination, Dennis Kucinich authored the law and help put it into place. The text of the law follows:

No owner of a professional sports team that uses a tax-supported facility for most of its home games and receives financial assistance from the state or a political subdivision thereof shall cease playing most of its home games at the facility and begin playing most of its home games elsewhere unless the owner either:

(A) Enters into an agreement with the political subdivision permitting the team to play most of its home games elsewhere;

(B) Gives the political subdivision in which the facility is located not less than six months' advance notice of the owner's intention to cease playing most of its home games at the facility and, during the six months after such notice, gives the political subdivision or any individual or group of individuals who reside in the area the opportunity to purchase the team.

The bizjournals.com article below discusses that yes indeed Ohio taxpayers were forced at the barrel of a gun to support the soccer culture. As someone who thinks we should minimize if not outright eliminate the utilization of force in the financing of collective goods, I do not understand Columbus Crew's argument? I don't understand how they were forced to accept money from taxpayers. I wonder how much they spent on legal fees--and whether they were briefed on this specific issue when accepting taxpayer money. "Ignorance is no excuse" is a rallying cry for state intervention.

The Dispatch article discusses whether such ORC provision might violate the Interstate Commerce Clause--but it seems this is an entirely voluntary system. No actor was forced to enslave Ohioans to their private subsidy--other than the taxpayers who were forced at the barrel of a gun to enable some people to kick around a ball for a few hours while ads and nationist and consumerist cultures are disseminated into the heads of people filtered in and managed like cattle for a few days a month, a few months out of a year. It will be interesting how these suits play out, and whether the Crew is forced to consider being sold--which we would imagine the federal 5th amendment may require just compensation. Perhaps Steem/DASH/ other cryptos looking to get their name out there could consider helping the people of Columbus purchase they team--and help to change the culture of state financing for cultural activities--which in someways is properly seen as propaganda.

The Dispatch article goes on to discuss various court cases and get quotes from elites. Perhaps the studpidest load of ship in the article was out the end where the author chooses to quote some actor name Andresen that asserts: "On one level, I wouldn’t want to be an attorney for the Columbus Crew right now"--unless the attorneys have already been paid for their services, most attorneys would be pleased as pigs to get to eat at the horse trough of the public apparatus that forces various actors to contract with them thanks to the state legal monopoly. I guess Andresen then goes on to acknowledge the work the lawyers will get to bill for thanks to the ambiguity of the contract and state regulations that make the allocation of rights unclear between parties--because that is likely the main goal of the legal monopoly porking up transaction costs for consumers and the public to the subsidy of their legal monopoly.

It will be interesting how this issues is manipulated due to the non total independence of the political process. As Saul Alinsky asserts there are two forms of power, organized people and organized money. Due to the intersection of all these actors and interests it is getting more coverage than it might have in a year without statewide elections involving an attorney general.


Overall the takeaway here is we are all cattle, except for the wolves among us with better connections to the coercive apparatus of the state. Instead of talking about the real issues of our time, the Dispatch and the people discussing these issues are subtracting from and masking our world. They got nearly 1% of us in cages already in merica--many for victimless conduct, and instead of talking about the police state, they wanna talk about a few people on a field kicking a ball.

As a huge Columbus Crew fan, I'm so curious to see how this plays out. Obviously I would love for the Crew to stay in Columbus, but I'm definitely not convinced that this law is enforceable. That would be incredible to buy the team as a city, that's the dream! Either way, I'll be at the game cheering on Saturday.
