The holding that a fetus is not a person, was a huge departure from the Common Law. At Common Law, a life in being became a person at the moment of conception. A child in vitro was capable at law of owning land, title and property. But somehow, even though the child has recognized lawful rights to land, property and title , this same child has no right to life. Which leads to the old saying "The Supreme Court is not final because it is always correct, but rather the Supreme Court is always correct because it is final. " God Bless and keep up the good fight.
