I know that I should feel like I've talked about the Rittenhouse trial enough; but, so long as there are halfwits who think he should have been found guilty it's worth voicing the correct opinion.
There was a moment in the trial that isn't famous enough in which Judge Schroeder shouted, "Don't get brazen with me!" at assistant DA Thomas Binger.
One of the reasons for that was that Binger brought up Rittenhouse's post arrest silence in front of the jury in order to try to paint Rittenhouse as a guilty person who wanted to hold his tongue until other witnesses spoke.
First and foremost, a prosecutor should never attack a defendant for exercising his or her constitutional rights in front of a jury. The right to remain silent is literally right there in the legally required Miranda Rights when a person is arrested. If Alec Baldwin has taught us anything it's that it's dumb to open your mouth when you might be facing legal liability.
Still, let's face it, if you watched the trial at all and you have any sense for human action, you know what Binger was doing and why the defense called for a mistrial with prejudice.
Binger knew he had no case; so, by wrongfully attacking Rittenhouse for exercising his Fifth Amendment right, he figured it was a win win. He knew that most jurors don't know enough about constitutional law to know that attacking a defendant for remaining silent is bullshit; still, he can plant that thought in the jurors minds. So, he might be able to get a conviction by manipulating the jury.
If he didn't get the conviction, and I absolutely believe this, his intent was to force a mistrial without prejudice which would allow him to regroup and try again. Binger was entirely out of bounds in his line of questioning and he knew it. He also knew that Schroeder has a history of being pro state and a mistrial with prejudice was unlikely.
He also knew that if he lost, which he thankfully did, he would still win political points with a ton of people who didn't bother to get a single fact of the case right and just decided that Rittenhouse was guilty from the beginning with literally no evidence.
To sum this of succinctly, the leftists who claim to be in favor of criminal justice reform and to oppose cops are either through willful ignorance or sheer hypocrisy supporting the very system that they claim to want to destroy.
