This is disappointing.
At least it is only the debt forgiveness of the SAVE Plan that is affected. The debt restructuring elements of the SAVE Plan are fine. And they honestly were the bulk of the program.
As far as I can gather one of the judges is relying on Missouri having standing via MOHELA like SCOTUS did when it rejected Biden's widespread debt forgiveness.
And they are using the dumb major questions doctrine.
I still found the original standing argument so bizarre.
Missouri got it through MOHELA even though MOHELA was separate from the state and wasn't even a party to the lawsuit.
And it is so weird to extend it to debt servicers, rather than lenders.
