I feel if you are hacked or pictures stolen from phone cloud etc. then they are guilty of theft. If they continue to share the stolen pictures then they are guilty of slander as well. There punishment should be equal to theft + slander
However, if one sends their pics to a significant other or whatnot and that person decides later to break off contact without retrieving or making effort to delete those pics, than as long as the possessor of those pics does not continue to share the pics then they should not be responsible for the mistakes of the original sender. Provided they are not continuing to share the pics in question, they are left with the pics themselves or should delete or return.
