Existe una línea divisoria tenue entre la aclaratoria y el recurso de nulidad y entre la aclaratoria y la apelación. La frase “sin alterar lo sustancial de la decisión” no siempre resulta clara.
Siguiendo a Frocham el recurso procede ante la parte dispositiva de la resolución, sin quitar que de existir incongruencia entre esta y los fundamentos o las razones dadas en los votos se la pueda intentar.
Una vez pronunciada y notificada la sentencia concluye la jurisdicción del juez respecto del pleito y no puede modificarla, así el recurso de aclaratoria es una excepción al principio.
