Today's Weed News for May 1st 2018 #TEXAS

For today's weed news we go to the great state of Texas.

The Texas Department of State Health Services is trying to put an end to CBD sales in the state, but the cannabis industry is fighting back.

Citing that because CBD is still labeled a controlled substance by the DEA and calling cannabidiol "not a legal nutritional supplement", the DSHS announced recently that they have drafted a plan to have all available CBD-containing products pulled off the shelves.

Thankfully, people like Denver-based cannabis attorney Robert Hoban, who believes that "Implementation of the protocol would cause Texas to fall far behind the rest of the nation for years to come in its treatment and regulation of the products," are already speaking out against this latest anti-cannabis protocol from the Texas DSHS.

Richard Cheng, an attorney representing the Texas Cannabis Industry Association, has even gone as far as to question the Department of State Health Services' knowledge on the subject and ability to make an informed decision by publicly saying that "Due to its nonexistent involvement throughout the legislative process the agency lacks education and understanding of how CBD and THC from hemp products should be regulated."

It looks like there's going to be a showdown about this issue sooner than later and that sick people in the state of Texas are the ones who have the most to lose. That is not to discount the hundreds of entrepreneurs and employees already involved in the Texas cannabis industry.

As of right now, there has been no date set for a final decision, but Dr. John Hellerstedt, the Texas Department of State Health Services commissioner will be the one making the final call. His decision will not be subject to any kind of appeal or review because it will be considered enforcement of an existing rule and not any kind of new regulation.
