This has been the problem for me up to this point. Yes, Trump lied about the election being stolen. That is immoral and harmful to our country. But if it is illegal then we need to do a deep dive into the Russian collusion hoax, because I am confident that a certain amount of lying has gone on with that. Lying to disenfranchise the incoming president is ugly but Trump is not the first one to do that and if we are to punish him then we have to seriously look at punishing others.
But the memo goes beyond lying. It is evidence of a distinct plan to overthrow the election. I know of no evidence that Clinton had a district plan to overturn the election. To delegitimize Trump yes and she should be condemned for pushing the collusion lie. But not something to allow her to directly gain office. This distinction allows for a prosecution of Trump but not Clinton.
I still think that Trump's biggest legal liability is the classified documents. It is a much more clear violation and easy to explain to a jury. But this memo puts the Jan 6 indictment up there in seriousness and if Trump somehow escapes the classified document mess, this can get him as well.
I heard a stat that about half of Republicans would vote for Trump if he was in jail on election day. Unfortunately, that possibility may well take place if the Republicans cannot figure out a way to knock him out in the primary.
