How Strong is an NDA?

With all the press covering the various women coming forward about affairs with President Trump, the same question keeps being put to our courts. “Can we get out of an NDA for specific reasons?” On the one hand the public demands to know certain information about the people that run the government… on the other hand these women signed NDA’s. The real catch 22 is that if the President is so adamant to NOT let them break the NDA and testify, then WHAT is he hiding? But is that simply a no-win situation?

She accepted money and signed the contract.

She has now violated the contract.

If the legal system is flawed (which it is) then make adjustments to the legal system.

Trump is sometimes, crude, boorish,and bellicose. Things we all knew long before he was even nominated, candidate.

Anyway the NDA is a contract, which if broken should have some consequences.
You can't have your cake and then burn down the bakery!

A non-disclosure agreement would, in my mind, violate the inalienable rights protected by the Constitution. Freedom of expression is protected by the 1st Amendment, and is considered an inalienable right.

On the other hand, if you sign a non-disclosure agreement, and fail to adhere to that agreement, then you may suffer consequences to your reputation. Social pressures can be enough to keep you in compliance with the NDA.

For every individual bound by an NDA, they must weigh the costs and benefits of adherence. For the women who are willing to violate the NDA in order to testify against Trump, they stand to gain enormous benefits in so doing. For the lowly employee who is a party to an NDA, he will suffer a blow to his reputation should he violate the NDA.

So the question is not whether one can or cannot blow off an NDA. The question is whether or not one is willing to suffer the consequences or enjoy the benefits of violating and NDA. It all depends on the context.

To put it differently, manufacturers who pollute the environment consider the cost of compliance and enforcement as a cost of doing business. To many manufacturers, the well-being of the community is a secondary concern (just think "DuPont").

Whether one chooses to honor a contract has more to do with the political and social power of that person than probably, any other factor. So sure, a woman who has suffered abuse from Trump can become an instant celebrity. A few talk show appearances and a book deal will more than compensate for the potential damage of violating an NDA, and in that case, these women "can get out" of an NDA.

There is no fear in truth. A righteous man is as bold as Lion. If the president have nothing to hide, why should he be worried. Let him be calm. In history, remember the president accused of such. He was tried in the court and eventually I think you can remember what happened. Let the president stay clear. I believe he will be exonerated.

With nothing and lies I think that if you have nothing to fear you should declare. But as we already know the personality of Trump everything that is around him has a lot of mediatic show in between and now as President is not the exception. Just as the allegations are true, I do not know to what extent his mandate will affect. Greetings from Venezuela

Yawn. The question is about NDA’s. Seriously not interested in the actual reason for the NDA. If you sign one, uphold one. Done.
