The Fifth Circuit grants the DOJ's emergency request to partially hold the ruling on mifepristone.

Access to the drug will remain for the time being, but the court will put on hold the FDA's changes in 2016 and 2021 that reduced the number of in-person visits from 3 to 1, made it available up to 10 weeks gestation instead of 7 weeks, and allowed distribution by mail.

I wouldn't be too optimistic here that the Fifth Circuit will eventually overturn the ruling. It is a very conservative appeals court. But this case will likely reach the Supreme Court soon. The DOJ can still ask the Supreme Court to fully block the ruling.

Separately a federal judge in Washington has issued an injunction to keep mifepristone available in 17 blue states plus DC.

Two of the three 5th Circuit judges are Trump appointees. The original Texas judge was a Trump appointee. We understate Trump's effect on the federal judiciary.

Try to square that section on standing with this reality. This drug is safer than penicillin and Viagra. It has significantly fewer major medical complications than surgical abortion and pregnancy itself.
