Here’s an update/summary on some of my legal/health concerns
for those of you following the story. I was first arrested on May 9th 2017 for “obstructing or resisting a peace officer” in his duty. Click here for the full story.I received a promise to appear and did so, but since they hadn’t laid any charges yet, my next court date was supposedly nullified, and I was to wait to be contacted with a new date. When I hadn’t received a new date after 6 months, I assumed the charges didn’t get laid after all.
I was technically a fugitive "at large"
Apparently, there was a warrant out for my arrest because I was supposed to appear in court after all, but I hadn’t been contacted. The VPD used the warrant to pick me up at a 420 Farmers Market/protest because they couldn’t charge anybody else with anything and needed to justify to the public eye the excessive police force used. Not just the back of a cop car this time
I spent the night in jail and really needed a dab when I got home! I talked to a Judge after my 24 hours and I was released with a new court date. I went back to Court a couple of times in March and April. First, I received my disclosure (particulars of the event) and was told to seek legal aid. The only legal aid in my area was on blackout until mid-May, so I represented myself against the Crown’s advice.
Mopping the Court room floor with the Crown
For total absolution, they wanted me to admit to and apologize for at least one count of obstruction. I said “I don’t think that would be appropriate”. I informally submitted a letter to the Crown stating the “inaccuracies” in their disclosure. Then, I stated my own disclosure of the story including that the RCMP should be apologizing instead of me, for I could press charges if I had the health and wealth. I asked the judge for a quick decision, so that I could go back to dealing with my derailed health conditions. After the Easter long weekend, my next Court date changed to a Stay of Proceedings, meaning it was all finally over, but I technically have a criminal record.
Still illegally healing
Now that Court is all over I can finally go back to dealing with my health. I’m being seen at the BC Cancer Agency for tumors in my pelvis. They aren't spine metastases - they are likely caused by the immense amounts of pelvic radiation I had as a child for spinal cord cancer. I was first diagnosed when I was 8-years old, and I still have not received a proper prescription for cannabis.
Some dirty details
I was initially supposed to receive a possession charge from the RCMP (for a few grams, far less than an ounce); however, a friend arrived on scene with his government-issued paperwork for cannabis, and then suddenly the search was no longer about drugs, and my possession charge turned into an obstruction charge. When I was arrested the second time, the VPD told me "if you really have been that sick for that long, you would already have the paperwork". I really have been fighting cancer for 20 years and illegally using cannabis for 12 of those. My case is being discussed by a tumor conference, and I have a follow-up appointment next week. Maybe I can finally get that proper paperwork before recreational "legalization" (aka corporatization) undermines the rights of patients and crushes the free market?
This is a great writeup of the "entire" incident and related incidents. Links to each segment of the saga.
I'm happy we can focus on health now, and trying not to get negative about all the lost time/energy/stuff.

Damned butt covering by the police why can't they just go do some real police work and go after the real crooks?

They tried to cover their butts, but they were too big, so they got a spanking anyway, haha! Thanks for the support, @kerrislravenhill :)

Bullshit. Healing yourself with cannabis is a Natural Right that can not be taken away from anyone, regardless of what a criminal organization (government) wrights down on paper.
C'mon folks, we don't live in a paper based reality.
I am very sorry you had to experience this. I have had my run-ins and definitely empathize with your situation.
We need to keep standing up for what's right and also start spreading the message that being an officer of the law is no longer (if it ever was) an honorable title to hold. I would love to live in world without injustices such as this. And yes, I know there are many much greater.
Thanks for sharing @medikatie!
