Unless we the people, by way of Constitutional amendment or statute, affirmatively limit the authority of government, we only rely on the discretion or prerogative of government officials when exercising their authority. That prerogative is bound to be exercised disparately and unfairly from time to time. The referenced article concerns an aggressive civil forfeiture action. When a civil forfeiture statute is broad enough to authorize a cash-starved government entity to seize a vehicle for going 5 mph over the speed limit, I suggest the statute has failed to properly reign in the potential abuse of authority and we are inviting unconstitutional seizures. Looks like the Supreme Court recognizes the issue. Sorry Jeff Sessions and other law enforcement hawks, but civil asset forfeiture abuse is way too common and its implementation is way too arbitrary. Let's reign it in and start giving those whose assets are seized a fair chance and due process to recover their assets.
