Ist Ripple XRP als Wertpapier einzustufen oder nicht?

Seit Dezember 2020 schwelt ein Rechtsstreit zwischen dem US-Fintech Ripple und der US-Börsenaufsicht SEC, der schwerwiegende negative Auswirkungen für einen Teil der Kryptobranche haben könnte. Konkret geht es darum, ob der Ripple-Token XRP, immerhin die siebtgrößte Kryptowährung der Welt, als Wertpapier einzustufen ist.

Das Volumen der XRP-Token-Verkäufe belief sich auf insgesamt 1,3 Milliarden US-Dollar. Entsprechend käme auf Ripple wohl eine immense Strafzahlung zu – und es könnte ein Präzedenzfall für ähnliche Kryptoprojekte geschaffen werden.

Von seinem Allzeithoch im Januar 2018 (rund 3,80 Dollar) ist der Ripple-Token aktuell weit entfernt. Seit Jahresbeginn hat sich der XRP-Kurs aber immerhin vervierfacht.

Sollte die Klage fallengelassen werden oder im Sand verlaufen, dürfte der XRP-Kurs – in einem positiven Umfeld – jedenfalls sicher nach oben schießen.

SEC versus Ripple: Urteil für 2022 erwartet

Richterin Sarah Netburn stelle „gute Fragen“ und habe erkannt, dass es in dem Verfahren nicht nur um Ripple gehe, so Garlinghouse. Der Ripple-CEO rechnet mit einem Urteil für 2022.

Ripple, das Alphabet und Andreessen Horowitz zu seinen Kapitalgebern zählt, wird mit rund zehn Milliarden Dollar bewertet.

Mein Persönliches Fazit:

Ripple der böse Bankencoin streitet sich nun seit über 1 Jahr mit der Amerikanischen Börsenaufsicht um eine endgültige Regulierung. Sollte die SEC vor Gericht mit ihrer Argumentation verlieren dann könnte der Kryptomarkt einmal mehr aufatmen. Persönlich sehe ich XRP nicht als Konkurrent zu Bitcoin sondern zum SEPA und Swift Überweisungssystem. Vielleicht ist dieser Gegner doch etwas zu mächtig?

** Should Ripple XRP be classified as a security or not? **

A legal battle between the US fintech Ripple and the US Securities and Exchange Commission has been simmering since December 2020, which could have serious negative effects on part of the crypto industry. Specifically, it is about whether the Ripple token XRP, after all the seventh largest crypto currency in the world, can be classified as a security.

The total volume of XRP token sales totaled $ 1.3 billion. Accordingly, Ripple would probably face an immense fine - and a precedent could be created for similar crypto projects.

The Ripple token is currently a long way from its all-time high in January 2018 (around $ 3.80). Since the beginning of the year, the XRP rate has quadrupled.

If the lawsuit is dropped or fizzled, the XRP price should definitely shoot up - in a positive environment.

My personal conclusion:

Ripple the nasty bank coin has been arguing with the American Securities and Exchange Commission for a final regulation for over 1 year. Should the SEC lose their reasoning in court, then the crypto market could breathe a sigh of relief. Personally, I don't see XRP as a competitor to Bitcoin but to the SEPA and Swift transfer systems. Maybe this opponent is a bit too powerful after all?
