New York is one of those annoying jurisdictions that only considers penile penetration of the vagina rape. The jury in Carroll's previous suit found Trump liable for sexual assault not rape, which included digital penetration, but not penile penetration. Both parties are bound by the verdict in the future litigation, so Trump might have a successful counterclaim that she defamed him after the verdict by saying he raped her.
