The Justice system of every country is set up to maintain law, order and also the last hope for every common man. In todays post I’ll touching on public and private laws alongside several examples. I’ll also be sharing a practical example.

But before going ahead, let me invite @ochelebe, @lovelystar and @bossj23 to participate in this challenge.


Part 1

Identify two examples each of public law and private law in your country and explain why these belongs to public or private law

Public law:

Is a branch of law that is concerned with matters affecting the country and makes sure public officials act lawfully for the benefit of everyone in the country.


Two Examples of law in this category includes;

  • Criminal Law: crimes such as murder, arm robbery, kidnapping, fraudulent activities are under the criminal code act. Government prosecute offenders to maintain peaceful coexistence in the country. For instance, if an offender kill someone unprovoked, the government will make sure you face the wrath of the law
  • constitutional law: This is another branch of public law that ensure there is a free and fair election. If it the citizens sense that election is rigged, they can petition the government in violation of the constitutional law. For example , in our last election in Nigeria, there was so many petitions both from civil societies, party candidates and lawyers against the electoral umpire which is “INEC”, regarding the irregularities in the elections.


Private law

Private Law is set aside to settle disputes between individuals, groups or businesses unlike public law that focuses on the interests of the country. One thing to also note here is that the government is not directly involved in handling disputes in private law.


Two Examples of private law includes;

  • Business Law: this law was created to regulate activities between business owners. If for instance, their is a bridge of contract between employers and employees, they can sue each other under the business law. In business law, there main focus is on the relationship between private individuals and organizations without the any intervention from government.

  • Property law: this law here focuses more on disputes over property, land , personal items etc. for instance, a dispute that has to do with land between two people involves resolution of competing claims without the state intervening in it. The primary aim of the property law is to protect the rights of ownership which is inherently private. The both parties are also equal before the law unlike public law where the state display there authority over an individual.

International law is one of the law I find most interesting because it governs relationship between countries, so that they can live together in peace and harmony in order to solve bigger issues like global challenges.


In cases of conflict between countries, the international court of justice, try to intervene to resolve it in order to avoid further bloodshed. This can be seen in the major role the ICJ has been playing to resolve the conflicts between Russia and Ukraine alongside Israel and other Arabian countries.


The dynamic nature of international law has made it both inspiring and also important in a world that’s interconnected.

Share a real-life experience—yours or someone else’s—that relates to any branch of law.

September last year, I had a little confrontation with one of my tenant because he was refusing to pay his rent and was fond of bringing up one excuse or the other. I became fed up and I told him to leave the house by December.


I thought I was doing the right thing because before you evict someone, you must give 3 months. December reached, I asked him when he was moving out, he begged me to give him little time. I gave him extra one month again, so he could sort out himself. At the end of January, it seems he wasn’t ready to move, I locked the door.


He came back begging and was giving me money to renew his rent. I told him I’m know longer interested in his money. That he should use his money to get a new place for himself. After much begging, I gave him another month. After gaining access to his room for 2 days we stopped seeing him in the house again. I didn’t bother to check up on him. All I wanted was for him to leave.


Two weeks later, On Valentine’s Day, early morning, this guy came with a full patrol police van to pick me up. Luckily for me, I was not around but they picked my aunt at home. I had to go to the police station. The charges leveled against me was that, I forcefully evicted my tenants without giving him a “quit notice”. I was so shocked that after giving someone close to 5 months to find a place, as long as he wasn’t served “quit notice”, it’s against the law.


Describe the legal situation in detail.

From what I’ve learned so far, this situation is governed by “property law”. As a landlord, I have every right to evict any tenant but I must follow the legal process. That is, providing an official eviction notice in written format stating the tenant must leave the property and the law doesn’t care how many months I’ve given him to sort himself out as long as it’s not documented down. Any deviation from this legal process, it’s null and void and it’s termed “forceful eviction”.


Secondly, According to the police, locking my tenants outside his home is illegal and violating his fundamental human rights.


Explain why you associate it with the chosen branch of law.

When it comes to disputes between two people on contractual basis, it’s clearly under the branch of private law since the agreement affects only the two people involved without any direct involvement with the government.


Property law covers anything that has to do with land, property, personal items etc. my own case is centered around landlord-tenant relationships which is subjected to the property law because they regulate the management of properties.


Just a little question before I go:

According to the private law, it has no direct involvement with the government. If that’s the case, why was the police involved in my arrest since is a private matter?? Because we all know that police works for the government
