Hello teacher
Am so glad to be a part of this class. I have always loved the subject of law. Thank goodness for this opportunity.
Say in your own words and based on what was explained in class: What is law? |
---|
Law is laid down rules governing the way people live their lives in a state or country. The law is there to prevent havoc.
The law cuts across every citizen in a country and it is given to maintain order. There are different types of law for example there is the objective law, subjective law, positive law, adjective law and the substantive law.
Considering the explanations given in class, according to the law and the laws of your country, I pointed out two examples of "Objective Law" and two examples of "Subjective Law".Case study:A citizen is driving a vehicle on the road and disregards the traffic light. Seconds later he is stopped by a traffic police officer and this citizen claims that he disregarded the traffic light because he was in a hurry to pick up his son and take him to the hospital because he is feeling unwell.Based on what you have learned, please state in which part of the case Objective Law and Subjective Law are present |
---|
The citizen driving the vehicle broke the law called the objective law. Obeying the traffic light is an objective law that is not a respecter of persons. This law has been set for safety precautions of all road users both those walking with their legs and those moving with vehicles.
Breaking the traffic light rules can put lives in danger. What if this citizen collided with a passersby or another car?
Objective law is the first law that definitely plays out in this case study because this law is compulsory for everyone no matter the person or situation.
The subjective law maybe applied after the citizen explained to the police the reason behind him breaking the traffic light rules which is to pick up his son and take him to the hospital. This is his motive for breaking the law.
Subjective laws are like the reverse of objective laws. These laws are subjective in nature with regards to movies, reasons and situations., they are not mandatory.
Based on what you have explained in class, make a comparison and according to the law of your country. Give an example of a law and an example of a norm |
---|
Comparison between law and norm
Law | Norm |
---|---|
Laws apply to all citizens of a state | Norms do not apply to all citizens, it is peculiar to certain people |
Laws are binded by a government | Norms are not binded by government legally. |
Laws are generally accepted | Norms are not generally accepted |
Laws are rules set by government | Norms are beliefs of a set of people set by sect. |
Example of a law in my country
The law against murder. In Nigeria where I come from, any one caught as a murder suspect is arrested, investigated and charged to court and it progresses to life in prison or death by hanging. It is a law that you can not take the life of another citizen.
Another law practiced in my country the law against rape. When caught in this act, suspect is also arrested and charged to court where other actions are taken.
Example of Norm in my country
There are people who believe that when a younger person wants to take or receive things from those older than him, he should do so using his right hands. A person violates their norm when he collects or receive things with the left hands.
Case study:Mr. Juan Perez rents an apartment but his financial situation is getting worse and he has not paid for 3 months. On one occasion, a meeting of apartment owners was held and the owner of the apartment where Mr. Juan Perez lives brought the case to the attention of the owners of the other apartments. They took the opportunity to say that they have received complaints from the neighbors of the building because Mr. Juan Perez has 4 dogs as pets in his apartment, something that is prohibited in the building's rules of coexistence.Analyze and explain in which part of the case Mr. Juan Perez is violating a law and in which part he is violating a norm |
---|
Mr Juan Perez owing for rents violates the law, no matter the reason behind his delay in the payment of rent. He is meant to pay his rent but he didn't so that a case of law violation.
There was a legal agreement mr Juan signed at the point where he got the apartment that he would pay up his rent, This made his rental of the apartment legal.
Mr Juan Perez having 4 dogs as pets in his apartment is a violation of Norm become having dogs as pets in the apartment is prohibited and was stated in the building rule. It's is a norm because it is rule on how they should conduct themselves as tenants. It is only binding as long as you live in that apartment. As long as he accepted to live in that apartment, it simply shows he agrees to the norm wither he believes it or not. This may not be the case in other apartments close by. This rule only applies to those who live in my Juan Perez apartment.
So Mr Juan Perez broke a law and a norm in the case study above.
Explain in your own words what importance Comparative Law has for you according to what you have seen in class |
---|
Comparative laws just as the name implies in my country Nigeria, helps to compare the laws set in other countries on specific crimes, in other to know if the laws we have made in our country is justifiable or it's to the extreme.
For instance, let's say the law for theft in Nigeria is death by hanging, if my country compares the law placed on a theft case in other countries and compares it with ours, we will realize that our law is to extreme and may decide to adjust the penalty to 5 years in prison rather than death.
Comparative laws also gives us a deep understanding about the laws applied in certain spheres of life and reasons they were made.
I would like to invite some friends to a join this contest. @lhorgic @eveetim @okere-blessing
Your comparison between laws and norms is very well-articulated. It’s a perfect example of how legal education can benefit society at large. Amazing effort.

Nice presentation of the lesson with detailed explanation. You're a good student who listens and practice what's taught because at a point I almost got lost.
Thank you for the invitation as I've made my presentation too. Best wishes!
