Law is very essential in any country in order to protect the rights of the citizens and also maintain and resolve legal issues within the nation.

-. Say in your own words and based on what was explained in class: What is law?
WHAT IS LAW?

Law simply refers to enforced rules and regulations created by the government of a country to maintain and protect the rights of citizens, social order, and also enhance justice.

Considering the explanations given in class, according to the law and the laws of your country, I pointed out two examples of "Objective Law" and two examples of "Subjective Law".
OBJECTIVE LAW

This is a law regarding clear and quantifiable standards in which subjective judgment and personal interpretation are limited.

Examples of Objective Law

  • Tax Law
    This has to do with the laws governing the taxation of a country, which includes individuals and businesses. It is also a mandatory law that both individuals and businesses must comply with.

  • Environmental Law
    These laws are made to maintain the natural environment, eradicate harmful human activities, and also conserve natural resources.

SUBJECTIVE LAW

This law gives individuals the room for expression of their personal opinions, values, or personal interpretations.

Examples of Subjective Law

  • Family Law
    This law governs family affairs, which include divorce, marriage, inheritance, child custody, etc., and also promotes healthy family relationships.

  • Employment Law
    This law looks into the relationship between employers and employees. Situations like wrongful termination and workplace harassment are governed by this law, ensuring that there is fair treatment and safe working conditions among employers and employees.

Case study:
A citizen is driving a vehicle on the road and disregards the traffic light. Seconds later he is stopped by a traffic police officer and this citizen claims that he disregarded the traffic light because he was in a hurry to pick up his son and take him to the hospital because he is feeling unwell.

Presence of Objective Law

The traffic light, including the rules governing it, is an example of objective law, which also specifies that a citizen's actions towards disregarding the traffic light attract penalties or fines from the traffic police.

Presence of Subjective Law

In his statement, he claimed he was in a hurry to take his son to the hospital, which made him disregard the traffic light. This is a clear interpretation of subjective law, in which the traffic police must decide based on the citizen's personal reasons if he is guilty or not.

Norms are unwritten rules made to govern human behavior, enforced through cultural norms and personal values to maintain cultural traditions and guide individual behavior.

LAWS AND NORMS IN MY COUNTRY; NIGERIA

Examples of a Law
  • The National Road Traffic Act (2011) regulates road traffic in Nigeria, including vehicle registration, driver licenses, and speed limits. It is stated in "Section 45" of the Act that driving on any public road at a speed exceeding 100 km/h is highly prohibited. The law is enforced by the "Federal Road Safety Corps" (FRSC) in collaboration with other agencies.
Example of a Norm
  • Respect is a customary culture in Nigeria, which highlights the importance of showing respect to elders, seeking their advice and blessings, greeting with a bow or handshake, and addressing them properly as "Mr." or "Mrs." It is not a government-enforced law but is based on personal values and cultural norms. Disregarding this norm might attract embarrassment and disapproval.
Case study:
Mr. Juan Perez rents an apartment but his financial situation is getting worse and he has not paid for 3 months. On one occasion, a meeting of apartment owners was held and the owner of the apartment where Mr. Juan Perez lives brought the case to the attention of the owners of the other apartments. They took the opportunity to say that they have received complaints from the neighbors of the building because Mr. Juan Perez has 4 dogs as pets in his apartment, something that is prohibited in the building's rules of coexistence.

Explain in your own words what importance Comparative Law has for you according to what you have seen in class.

Comparative law gives us the idea of comparisons in addressing any legal issues. It helps us understand how other countries and cultures resolve legal issues. It highlights the importance of adopting best practices, experiences, and the ability to learn and develop solutions to complex problems. It helps us compare our laws with different legal systems, identifying areas for improvement.

For Example; In my country, Nigeria, based on the development in sports in other countries, our government has invested so much in sports to upgrade sports infrastructure here in Nigeria, like training facilities and standard stadiums. They have set out programs to encourage grassroots sports development. This is an implementation of comparative law.
