President Director of PT BNI Life Insurance (Persero) from 2008 to 2018, Hendrisman Rahim appealed against the decision of the judges Court of Criminal Acts of Corruption (Corruption) Jakarta ruled her life.
The panel of judges at the Tipikor court previously sentenced Hendrisman to life because he considered that he was proven to have committed corruption that caused losses to state finances amounting to Rp 16.807 trillion in cases of corruption in managing funds and the use of investment funds at PT Asuransi Jiwasraya (Persero) in a hearing held Monday (12/10).
"We will appeal," said Hendrisman's legal adviser, Maqdir Ismail, when contacted in Jakarta, Tuesday (13/10).
Maqdir said he was surprised by the verdict given to his client. Hendrisman even questioned the verdict at the trial.
"To be honest, I was shocked when it was stated that the sentence imposed on Pak Hendrisman was with a life sentence. Likewise, Pak Hendrisman was very shocked, that he asked me, what is the meaning of a life sentence?" said Maqdir.
The verdict was heavier than the demands of the public prosecutor (JPU) at the Attorney General's Office, who asked Hendrisman to be sentenced to 20 years in prison and a fine of Rp. 1 billion, subsidiary to 6 months in prison.
"I said it means that the sentence ends if the person sentenced dies," added Maqdir.
In fact, according to Maqdir, he did not hear from the judge's consideration that Hendrisman's real actions were so significant that he deserved a life sentence.
"Moreover, the verdict was drawn up in reverse, the judge actually found the defendant guilty, then considered the defense and prosecutors' demands, heard the judge's considerations, which was really disappointing," said Maqdir.
According to him, quite a lot of arguments from him and his client were not read out for their considerations and in fact were not even considered.
"In my mind, from this verdict, what 'lies' are to be hidden from this life sentence. As far as I know, the verdict in a corruption case that is made into a new uniform for this case, regardless of what the role of the person is, the sentence must be the same, the sentence of life life, "said Maqdir.
Apart from Hendrisman, three other defendants, namely the Jiwasraya Finance Director for the January 2013-2018 period Hary Prasetyo, the Head of the Jiwasraya 2008-2014 Investment and Finance Division Syahmirwan and the Director of PT Maxima Integra Joko Hartomo Tirto were also sentenced to life sentences.
"Pak Hendrisman, for example, was charged with 20 years, which is very surprising for us. Moreover, the judge decided to give a uniform sentence of life imprisonment, including Syahmirwan, who was sentenced to 18 years who was also sentenced to life. as a form of tyranny on behalf of law enforcement. Still, these are the facts, "explained Maqdir.
The panel of judges chaired by Susanti Arsi Wibawani stated that Hendrisman, Hary and Syahmirwan's actions were carried out together so that it was fair to be given the same sentence for the three.
"The defendant is not someone carelessly in making decisions and is not a new person who is involved in insurance and the capital market and has an amazing track record. This indicates that the defendant is a superior human resource who deserves to be appreciated for saving Jiwasraya insurance from adversity. However, the defendant trapped in personal interests so it is fair if the three of them are sentenced to the same sentence, "said the judge.
The judge also stated that from his actions, Hendrisman received benefits in the form of:
Cash amounting to IDR 875,810,680 and PCAR shares of 1,013,000 shares worth IDR 4,590 / share on January 24, 2019 worth IDR 4,649,670,000 so that the total value reaches IDR 5,525,480,680;
