Organ donation is the process of taking healthy organs and tissues from one person and transplanting them into another person. Organ donation is a generous and meaningful decision that can save the lives of many people.

Now let us discuss whether organ donation is legal or illegal in our country.

It depends on whether the organ donation is being done with the consent of the donor or he is being forced to donate the organ due to some compulsion.

The person who donates the organ is called the donor. And the person who receives the organ is called the recipient.

The organs that we can donate are our eyes, kidneys, heart, liver, lungs, intestine, pancreas and skin.

When a person suffers from cardiac death, the heart stops beating, in such a situation donating the heart of this person becomes useless.

But their bones, skin, heart, etc. can be donated within 24 hours before death.

Illegal

Organ donation done by any person without his consent or by force or by taking advantage of someone's helplessness is called illegal.

This illegal organ donation is done by taking advantage of the helplessness of poor, labourers, helpless people and by luring them and this also benefits the agents and hospitals by crores of rupees.

Many times, small children are kidnapped and their organs are fraudulently removed and sold. Due to which the kidnappers and agents earn a huge amount.

Those who are contributing to this dark or corrupt system are called illegal.

Legal

Organ donation done by any person with his will is called legal.

For example, when a person's organ gets damaged due to any disease or any other reason and he needs to take organ donation from someone. Because organs are not sold in the market. So the family or friends of that person donate the organ to him after matching his compatibility. Which is transplanted in the body of that sick person.

Sometimes when a person is about to donate, he donates all his organs for someone's benefit on his own will.

The primary law related to organ donation and transplantation in our country is the Human Organ Transplantation Act. Its purpose is to exchange human organs for removal, storage and transplantation for medical purposes. Under this rule, trading in human organs is not allowed.

For organ donation, a donor form has to be filled and signed by two witnesses. And to donate any unrelated data, permission of the state government's authorization committee should be taken.

All methods of organ donation make the life of a needy person better and also save him from the jaws of death. Organ donation done in this way is considered completely legal.

The conclusion is that organ donation should not be made a business, and if organ donation is done to save someone's life, then it is considered completely legal.

Organ donation is legal in many countries, but unscrupulous people knowing that there is a high demand for people needing transplants, kidnap and kill people and sell their organs, when this becomes very illegal, people who do this are given jail and even death sentence. But still there is no reduction in such crimes. People commit crimes secretly, and promote corruption.

I believe that those organ transplantation so not be held as business as you mentioned but few of the people had doing this.
