Part I

Choose a law from your country and explain why you consider it to be part of procedural law or procedural law.

One law in our country is the Code of Criminal Procedure 1898, which is known as CrPC. This law has been in force since before 1971 and has been in force even after the independence of the country.

The criminal procedure is followed by the investigation of the criminal incident and the arrest of the accused criminal and the punishment is formulated through the court trial. such as

An accused criminal is arrested by the police after investigating any criminal incident. Then according to the time limit, the trial is conducted through the evidence of both parties through the Bhoja Dari Act.

After the trial and analysis, the accused criminal is given a verdict of sanity and later punished by the man of law.

B. I indicate which principles of procedural law are present in that law and why.

Criminal law is the process by which crimes are investigated and penalized.

By this law both the plaintiff and the defendant are required to prove their respective responsibilities before the court imposes punishment. That is, both parties are given equal rights to be acquitted of conviction.

The Act specifies how a law officer should investigate a crime and bring the guilty to court. After that, it is mentioned here how the punishment will be proved to the criminal if he is found guilty.

Through this law, a magistrate conducts the trial by analyzing all the necessary documents of the case. Judicial proceedings cannot be concluded without following this law.

Part II

Mr. Ramirez rents a commercial space from Mr. Perez. But it appears Mr Perez has begun using the premises as a home, something which was prohibited by a clause in the contract.

Mr. Ramirez decided to go to court and demand the cancellation of the contract for breach of that clause. During the case, Mr. Ramirez promoted a judicial inspection of the commercial premises that Mr. Perez was actually using the premises as a home, the court agreed to the judicial inspection and set the day, time and date of carrying the same out.

Here Mr. Perez breached the contract and engaged in a criminal act. In that case, Mr. Ramirez should have been sued. In this case, he did not take the law into his own hands but demanded its justice through the scope of the law.

Here procedural and procedural laws are used. because,

Procedural law is a process by which two parties get justice by presenting information and both parties have the right to face the accused. Also the process of justice by analyzing the information of both parties is called procedural law. Through this act, Mr. Ramirez can file a lawsuit in court.

On the other hand, Procedural Law is that according to the order of the court, the man of the law finds out the facts and brings the criminal to the court and punishes him according to the order of the magistrate. All procedural acts are called procedural acts.

Through all these laws both the parties have equal rights and the innocent plaintiff or defendant gets the right through trial. Legitimacy is analyzed through these laws.

A.- Say, according to what you have seen in class, which event in the case do you mark with "procedure" and explain the reason for your answer.

According to the facts of the two parties, the court performs the judicial function. Then the guilty party is punished and the innocent party is restored to his due rights. This is the procedural law provision. There is no illegal information or exclusive trial here. Through this law all types of roles of both sides of the cases are determined.

The judicial system is completed through procedural laws, starting from the gathering of information about the criminal incident to the judicial analysis of the magistrate or court. The process of completing all these activities is called process law.

Part III

Mrs. Maria is driving a car and her brakes go out and she collides with Pedro's car, causing several damages. Given the situation and unable to reach an agreement, Pedro decides to sue Maria and file a case in court and after leaving the court he learns that the car belongs to Mr. Manuel.

A.- Identify the procedural issues according to what was explained in class and identify them in each character present in the case. Explain why you gave your answer.

Procedural law requires the presence of either the plaintiff or the defendant. Here the plaintiff has filed a case against the defendant
Pedro and the defendant are Maria. Because of the woman and the accident, Pedro Pred suffered personal damage.

After the filing of the case, the judicial process is completed through the procedural law. Here, of course, data from both sides is analyzed. On investigation, it was revealed that Maria braked the car. Here the third party car is the property of Mr. Manuel. Since this law includes criminal cases all involved activities must be explained.

Since the procedural law procedure is conducted by all kinds of investigation and information from both parties. Here as all the facts are disclosed and all the parties involved are given priority, it seems to me that the process is completed through procedural law.
