For Muslim marriages to be recognised in South Africa, a separate civil ceremony had to be conducted. This had to be done either in terms of the Civil Union Act [No. 17 of 2006] or the Marriage Act [No.25 of 1961]. If this were not done, the marriage would have been treated as a putative marriage out of community of property and with the exclusion of the accrual system.
