"An ardent Trump supporter whose enthusiastic participation in the January 6 riot saw him labelled an FBI infiltrator when he was not charged is considering suing podcast host Joe Rogan for claiming he was working to stir up the rioters.
Ray Epps, a 61-year-old former Marine from Arizona, was prominent in the riot but notably absent from any subsequent indictments.
Conspiracy theorists seized on that as evidence of Epps being a government 'plant', working to whip up a riot. The allegation was repeated multiple times by Tucker Carlson, on Fox News, and then by Rogan.
Epps sued Fox last month for defamation, seeking unspecified damages.
On Thursday his lawyer confirmed they were also considering suing Rogan.
