A Fairfield municipal court judge is now being sued along with the city, over accusations that she regularly violated the Constitutional rights of the people. The federal lawsuit is allegedly seeking class-action status and asserts that the judge in question had perpetrated policies and procedures that violated rights by failing to uphold the Constitutionally-protected right of the people to appear before a judicial officer in a timely manner.
The U.S. Supreme Court has previously asserted that the state must demonstrate extraordinary circumstances if they are going to delay that right of someone to see a judge in a timely manner after they've been arrested.
It's alleged that this individual had been held for 5 days without seeing any judge and without any bond being set. They'd also hired a lawyer and even their lawyer admits to having difficulty in trying to have their client released.
It's been revealed that dozens of people have allegedly been identified as having their constitutional rights violated when they were held more than 48 hours without being allowed to see a judge, at least 35 people within just the last 2 years alone.
For every day that passes that is another day that can destroy someone's life if they are unjustly detained; they could lose their job, or lose custody of their child etc.
If it's true that the American people are routinely having their Constitutional rights violated by this judge and city authorities then it's about time that someone brought legal action forward to expose the injustice and attempt to correct the wrongdoing. You don't serve a community by denying them their basic rights. The case was reportedly filed at the beginning of February.

This is not a new ploy. It is a common tactic, and it is vile. It needs to end, and I am earnestly hoping this lawsuit does that.

I can picture things being of a slower pace in a smaller town but not in the case of basic freedom.
It would take some serious balls as a defence lawyer to kick off a case like this or participate when the lone judge could make life miserable for them going forward.
Enforce the letter of the law and follow that same letter.
