Who is a prisoner?

A prisoner is someone in chains or in the confines of a room where they can't be free because they are serving a jail term which wasn't given to them by a judge

As a jailer, they remain in the same cell for 12 hours in the same jail a prisoner stays for 24 hours, so in order words they are still prisoners.
