Pasando por los cortos senderos de mi vida, tuve la oportunidad de conocer un poco desde mi subjetividad, más de cerca el actual Sistema de Justicia Penal Venezolano, mas especifico en el cuerpo de Alguacilazgo, donde por ser un cuerpo articulador con los demás, relacionados a la administración de justicia, me tropecé con un conjunto de cargas inerciales; estas vinculadas a la forma que cada uno de los individuos, intervienen dentro del mismo sistema.

Para entender este largo y complejo círculo vicioso que desde mi humilde perspectiva de ver el mundo, es necesario comprender el contexto de cada uno de estos elementos: Desde el ciudadano común de los distintos sectores populares, que por otro complejo sistema de estructura social son los más vulnerables para ponerse al margen de las leyes. Es curioso y hasta suena descabellado, pero pareciera que estos sectores, estuvieran destinados a ser los protagonistas del sistema, entendiendo este protagonismo como los villanos del cuento, los que están en el paredón esperando ser fusilados, los juzgados por los “buenos”, los pobres.

En el segundo escalafón se encuentran los iluminados cuerpos de seguridad, que ejecutan los procedimientos, algunos actuando con profesionalismo y sentido ético considerable, otro no tan éticos, estas acciones vinculadas a la formación del funcionario, tanto de valores éticos y morales correctos, como espirituales. Teniendo en su poder, las primeras actuaciones, en algunos casos desviados de la realidad para perjudicar a la persona que comete el delito y terminarlo de sumergir en el infierno terrenal (Privación de libertad), o en su defecto apilar una causa más en el empolvado archivo judicial. Cabe destacar, que esta es una carga inercial que empieza a debilitar el sistema de justicia penal, luego entra el Ministerio Publico, organismo encargado de la parte investigativa, y el titular de la acción penal. La fiscalía del MP trabajando mancomunadamente con los elementos mencionados anteriormente y las victimas del hecho punible, se topa con las debilidades institucionales inherentes a la estructura del sistema, poniéndosele cuesta arriba la búsqueda de la verdad.

Going through the short paths of my life, I had the opportunity to learn a little from my subjectivity, more closely the current Venezuelan Criminal Justice System, more specific in the body of Alguacilazgo, where for being an articulating body with others, related to the administration of justice, I stumbled upon a set of inertial charges; they are linked to the way each one of the individuals intervenes within the same system.

To understand this long and complex vicious circle that from my humble perspective of seeing the world, it is necessary to understand the context of each one of these elements: From the common citizen of the different popular sectors, that by another complex system of social structure are the more vulnerable to get outside the laws. It is curious and even sounds crazy, but it seems that these sectors, were destined to be the protagonists of the system, understanding this role as the villains of the story, those who are in the wall waiting to be shot, judged by the "good", the poor

In the second tier are the enlightened security bodies, which execute the procedures, some acting with professionalism and considerable ethical sense, another not so ethical, these actions linked to the formation of the official, both of ethical and moral values ​​correct, and spiritual . Having in its power, the first actions, in some cases deviated from reality to harm the person committing the crime and finish submerging him in the earthly hell (Deprivation of liberty), or failing to stack one more cause in the dusty judicial archive. It should be noted that this is an inertial load that begins to weaken the criminal justice system, then enters the Public Ministry, the agency in charge of the investigative part, and the head of the criminal action. The public prosecutor's office of the MP, working jointly with the aforementioned elements and the victims of the punishable act, runs into the institutional weaknesses inherent in the structure of the system, putting the search for the truth uphill.

Luego todo este conglomerado de actuaciones son presentadas en el siguiente escalafón del sistema; Los tribunales, las cuales son los competentes para conocer y decidir los procesos penales; sea cual sea su etapa (Control, Juicio, Ejecución). En este sentido, nos encontramos con el “Monstruo del Sistema”, por cuanto es donde se articulan todos los elementos ya descritos en estas líneas, arrastrando ese conjunto de cargas inerciales; partiendo desde los villanos del cuento (individuo que posee la conducta delictiva), víctimas y testigos que luego de estar inmersas en este Monstruo Invisible se sustraen y no comparecen al llamado de los tribunales aportando al retardo procesal y en algunas casos coaccionadas para que la realidad no sea contada, actuaciones truncadas por los funcionarios actuantes que luego a la hora de declarar entran en contradicción, y de igual forma por el mismo conflicto algunos no comparecen, trayendo consigo al titular de la acción penal (Fiscalía del Ministerio Publico) falta de elementos de convicción para demostrar la culpabilidad de un individuo en un hecho punible, aunado a esto la ausencia de talento humano dentro la misma institución del MP que dificulta la eficiencia y eficacia a la hora de investigar.
Otro elemento interviniente en el monstruo invisible son esos “Profesionales del Derecho” (Defensores Privados) con falta de ética que se valen del valor mas preciado de un individuo, la libertad y la dignidad, para sacarles unos “churupitos”, orquestando un conjunto ideas disociadas de la realidad, dándole esperanzas inexistentes al “villano” y a los familiares afligidos, muchas veces dejándolos en la quiebra y para los sin suerte condenados. Estas actitudes asociadas a un precario sentido ético, moral, humano, solidario, anteponiendo el valor de esos “churupitos” a la búsqueda de la verdad.

In this sense, we find the "Monster of the System", because it is where all the elements already described in these lines are articulated, dragging that set of inertial loads; starting from the villains of the story (individual who possesses the criminal behavior), victims and witnesses who after being immersed in this Invisible Monster are subtracted and do not appear at the court's call, contributing to the procedural delay and in some cases coerced so that the reality not counted, actions truncated by acting officials who then at the time of declaring enter into contradiction, and likewise for the same conflict some do not appear, bringing with them the head of the criminal action (Office of the Public Prosecutor) lack of elements of conviction to prove the guilt of an individual in a punishable act, coupled with this lack of human talent within the same MP institution that hinders efficiency and effectiveness when investigating.
Another intervening element in the invisible monster are those "Legal Professionals" (Private Defenders) with a lack of ethics who use the most precious value of an individual, freedom and dignity, to get some "churupitos", orchestrating a set of ideas dissociated from reality, giving nonexistent hopes to the "villain" and the afflicted relatives, often leaving them bankrupt and for those without luck condemned. These attitudes associated with a precarious ethical, moral, human, and solidary sense, putting the value of these "churupitos" before the search for truth.

Del mismo modo el Juzgador (Juez) desde su contexto se encuentra con un monstruo invisible que se torna visible, teniendo en sus espaldas la responsabilidad de enderezar esa estructura que viene deteriorada por ese conjunto de cargas inerciales, ese sistema tan complejo que arrastra consigo un sinfín de elementos y experiencias individuales, cada una de ellas dentro de un contexto histórico invisible. Todo esto resumiéndose en una imperceptible sentencia, bien sea absolutoria o condenatoria, por cuanto quehacer diario del juzgador lo hace cotidiano. “Existen dos tipos de verdades, la Verdad Verdadera, y la Verdad Procesal”, palabras estas dichas por un juzgador un día en mi caminar por el sistema.
Estas humildes líneas me llevan a una profunda reflexión, sobre lo que es realmente el sistema de justicia penal, llegando a la conclusión que el problema es estructural, radica en las bases, en nuestra idiosincrasia cultural, a la falta valores y de educación liberadora para la transformación, al nivel de conciencia social, política, espiritual, a la forma que nos comportamos con esos sectores invisibles, a Los Nadie, como lo plantea Eduardo Galeano, refiriéndose a las “imágenes invisibles de nuestra realidad, las personas ocultas que enfrentan el desprecio y la indiferencia; y se llevan la peor parte: el hambre, la pobreza y la miseria”. Aún recuerdo la conversación con dos privados de libertad que me llevaron a un conflicto interno de introspección, diciéndome: “Algunos acá ya estamos condenados en el infierno, y el sistema se ha encargado de que esa reinserción en la sociedad se vea bastante lejos, ve a darle esa palabras de aliento y consuelo a nuestros niños, en las comunidades, para que no lleguen a ser como nosotros”. “Nosotros somos unos perros de guerra, que día a día vivimos batallas internas con nosotros mismos y externas con la sociedad, en cada audiencia saltamos a la batalla desarmados, nos defiende es el dinero, si no lo tenemos estamos jodidos”

In the same way the Judge (Judge) from its context encounters an invisible monster that becomes visible, having on its shoulders the responsibility of straightening that structure that is damaged by that set of inertial charges, that complex system that carries with it a endless elements and individual experiences, each of them within an invisible historical context. All this is summarized in an imperceptible sentence, whether it is absolutory or condemnatory, because daily tasks of the judge make it daily. "There are two types of truths, True Truth, and Procedural Truth", words said by a judge one day as I walk through the system.
These humble lines lead me to a deep reflection on what is really the criminal justice system, reaching the conclusion that the problem is structural, lies in the bases, in our cultural idiosyncrasy, the lack of values ​​and liberating education for the transformation, at the level of social, political, spiritual awareness, to the way we behave with these invisible sectors, to Los Nadie, as Eduardo Galeano puts it, referring to the "invisible images of our reality, the hidden people who face the contempt and indifference; and they take the worst part: hunger, poverty and misery. " I still remember the conversation with two inmates that led me to an internal conflict of introspection, saying: "Some of us are already condemned in hell, and the system has made sure that this reintegration into society is seen far away, see to give those words of encouragement and comfort to our children, in the communities, so that they do not become like us. " "We are dogs of war, that every day we live internal battles with ourselves and externally with society, in each audience we jump to the battle unarmed, it defends us is money, if we do not have it we are screwed"
