OPEN LETTER TO ALL LAW ENFORCEMENT OFFICERS BY WE THE PEOPLE

Dear Law Enforcement Officer,

This is a First Amendment petition expressing our grievances about how you are carrying out your government law enforcement duties as our employed public servant.

We are the Civilian Authority of We the People of the United States of America - the first branch of government and force of last resort since 1776 - now the largest armed force in the world (US military is #2 after us).

[A survey by the First Amendment Center at Vanderbuilt U. found that over 94% of Americans are unaware of their First Amendment right to petition their government and what petitioning really means. Petitioning government is a right acquired in the Western world in the 1200s through the Magna Carta Libertatum (The Great Charter of Liberties), which was a basis for the US Constitution, and especially the Bill of Rights beginning with the First Amendment right to petition. Petitioning means the right to redress grievances with your government by condemning, criticizing and complaining about your government with impunity. There are a number of issues that we have with your approach to policing us that begins with...

MISUNDERSTANDING YOUR FUNCTIONAL ROLE AS AN INDEPENDENT CHECK AND BALANCE AGAINST GOVERNMENT TYRANNY

Before America was founded kings ruled the world like absolute despots with complete and total governmental powers vested in one man. We the People decided to check the potential for such despotic power that threatens everyone's rights.

We did this by creating a new form of government that divides governing powers into three separate and independent branches: legislative for making laws, executive for enforcing those laws and judicial for ruling on those laws. The balance of governing powers we reserved for ourselves under the Ninth and Tenth Amendments, which includes all the powers we delegated as well.

You are serving We the People in the law enforcement branch, which has the unique specific function to protect We the People from unconstitutional legislation. The problem we have with you is that 99% of leos like you are thinking it is your duty to enforce any and all legislation that gets signed into law that comes down from Congress, your state legislature or local city hall no matter how unconstitutional it may be.

Our main issue is LEOs not using their long established discretion to arrest (Justice Scalia, "a well-established tradition of police discretion has long coexisted with apparently mandatory arrest statutes.") when it comes to enforceing unconstitutional laws, especially those related to the abridgement, infringement and unwarranted transgression of our First, Second and Fourth Amendment rights.

"The police have a duty not to enforce the substantive law of crimes unless invocation of the process can be achieved within bounds set by constitution, statute, court decision, and possibly official pronouncements of the prosecutor. Total enforcement, were it possible, is thus precluded, by generally applicable due-process restrictions on such police procedures as arrest, search, seizure, and interrogation. Total enforcement is further precluded by... specific procedural restrictions... Such restrictions of general and specific application mark the bounds, often ambiguously, of an area of full enforcement in which the police are not only authorized but expected to enforce fully the law of crimes. An area of no enforcement lies, therefore, between the perimeter of total enforcement and the outer limits of full emforcement. In this no enforcement area, the police have no authority to invoke the criminal process." (The Yale Law Journal - Volume 69 Number 4 March 1960 Police Discretion Not to Invoke the Criminal Process)

How are you not blindly following orders in the same disastrous manner the gestapo blindly followed the orders of the Nazi party under Hitler resulting in the unwarranted disarmament and genocide of millions of German citizens?

Because something becomes a law, that doesn't mean it is constitutional and worthy to be followed by us or enforced by you. We live in America not Nazi Germany and we expect you to understand and respect that fact and behave responsibly by upholding and defending the Constitution as the highest law of the land. Those who do not learn the mistakes of history are doomed to repeat them!

FOLLOWING AND ENFORCING UNCONSTITUTIONAL LAWS IS NOT YOUR DUTY! WAKE UP! THAT IS NOT YOUR DUTY!

You took an oath to uphold and defend the Constitution of the United States of America, which was established by We the People. The Constitution delegates power to form a government to secure our rights, and constitutes the highest law of the land. Statutes do not have the power to overrule the Bill of Rights.

WHEN YOU TOOK YOUR OATH OF OFFICE TO UPHOLD AND DEFEND THE CONSTITUTION YOU TOOK AN OATH TO WE THE PEOPLE WHO ESTABLISHED THE CONSTITUTIONAL RULE - NOT TO THE SUBORDINATE GOVERNMENTS FORMED BY THE CONSTITUTION (CONGRESS, STATE OR CITY HALL ETC)!

We delegated power to those government bodies to pass legislation that does not violate the Constitution. As such, the Supreme Court has ruled that any laws that violate the Constitution are null and void and not enforceable by law enforcement officers like you.

YOU ARE THE FIRST LINE OF DEFENSE IN PROTECTING WE THE PEOPLE FROM UNCONSTITUTIONAL LAWS AND 99% OF YOU DON'T EVEN REALIZE OR RESPECT THAT FACT.

You as an individual officer have taken an oath to uphold the Constitution and not enforce unconstitutional laws. As an individual law enforcer you need to have enough intelligence and integrity to understand the Constitution and Bill of Rights and to know when a law violates those principles, and when it does, to not enforce it and stand up for the rights of We the People.

For example, the Second Amendment to the Constitution states,

Amendment II
A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

That means any arms. all types of weapons were possessed by Americans from day one without exception. "Shall not be infringed" clearly means no restrictions whatsoever.

Since this amendment was passed legislators have been violating the Constitution with an endless flood of infringements on this basic God-given right to self-defense. All laws infringing the exercise of our Second Amendment rights are unconstitutional, null and void and unenforceable.

If you have ever enforced any law infringing our rights to keep and bear arms of any type, then you have violated your oath to We the People. That is the highest punishable crime of treason against We the People. We the People includes all your family and friends you have let down. When you violate one person's rights, you violate every American's rights. Try to understand.

The same goes for the First Amendment rights of all Americans, which includes the right to peacefully assemble anywhere in the public space or on private property with permission of the property holder. It also includes the right to free speech, to petition (complain, criticize, condemn) the government for a redress of grievances and so on.

Amendment I
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

When you try to abridge our free speech and assembly rights to a designated restricted area free speech zone, you are violating our rights and your oath to We the People. The entire public space of the United States is a free speech and peaceful assembly zone where we can petition the government without the need for a permit. We don't need your permission to exercise the First Amendment or Second Amendment rights. We already gave ourselves permission when we ratified the Bill of Rights!

Our Fourth Amendment rights are being disrespected by leos because 98% of cases never go to trial due to predatory intimidating plea bargaining practices. Therefore leos like you don't think it matters how you collect evidence, engage in warrentless searches and seizures or make baseless arrests because you know it won't get thrown out at trial - because you know there will not be any trial or jury in nearly all cases! You are violating our rights when you do this and violating your oath to We the People.

Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

YOU NEED OUR SUPPORT AND CONSENT TO AGREE TO BE GOVERNED BY YOU.

We want to be able to support you, but you need to be supportable by not enforcing unconstitutional laws. That is the purpose of this letter - to mediate this dispute and get it resolved so we can support you. We are not anti-government anarchists, and neither are we compliant subservient subjects of tyrants, despots or dictators!

IF WE WITHDRAW OUR CONSENT TO BE GOVERNED BY IMPEACHING YOU UNDER OUR SUPREME CIVILIAN AUTHORITY, UNDER GOD, THEN YOUR TYRANNICAL GAME WILL COME TO A QUICK END THE SAME WAY IT ENDED FOR THE TYRANT MAYOR AND SHERIFF IN THE HISTORIC US BATTLE OF ATHENS TENNESSEE.

Question 1: Why should we support leos who violate the constitution by enforcing unconstitutional laws or enforcing constitutional laws in an unconstitutional manner?

Question 2: Why shouldn't we withdraw consent to be governed by rogue unconstitutional leos and exercise our reserved Ninth and Tenth Amendment rights and governmental powers as the Civilian Authority of We the People to alter or abolish the government by impeaching, indicting, convicting, sentencing, arresting and punishing rogue leos for treason through due process of Civilian Law?

Amendment IX
The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

Amendment X
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

OUR BOTTOM LINE: WE DO NOT CONSENT TO ANY ABRIDGEMENTS OF OUR FIRST AMENDMENT RIGHTS, INFRINGEMENTS OF OUR SECOND AMENDMENT RIGHTS OR UNWARRANTED TRANSGRESSIONS OF OUR FOURTH AMENDMENT RIGHTS.

WHEN YOU VIOLATE OUR RIGHTS YOU BECOME A TYRANT AND WE DO NOT SUPPORT TYRANTS OR CONSENT TO TYRANNY.

YOU CAN ONLY HAVE OUR SUPPORT IF YOU AGREE TO SECURE OUR RIGHTS BY SIGNING AND UPHOLDING THE CONTRACT WITH AMERICA. THERE WILL BE NO OTHER DEAL OR OFFER OR NEGOTIATIONS IN THIS REGARD.

We are ready to offer amnesty to constitutional offenders, who have not used violent or deadly force in past violations of the rights of We the People, who sign the Contract With America and cease and desist from all further violations of our constitutional rights.
