This is an English translation of my Ronbun (A dissertation) previously published as "22世紀組織論".
Please forgive me that you'll must be difficult to read because of my poor English ability.
Also, since Japanese is also posted, please use it for studying Japanese.

If you do not know the deepest psychological description along with the actual situation, there is no solution can be found forever・・・

If the top of the organization hints obscurely that they'll do illegal work willingly by themselves,
Intermediate administrators do Instruct subordinates as an Important thing with absolute authority,
The lower classes know that's fraud but they carry out it in a pretty mess.

"The top is hinting only, the bottom people are hectic and carried out."

This applies to any group, anti-social organizations such as gangs, private organizations, and state organizations.
Because "It's a natural truth in human organizations."
The organizational structure of developed countries is still primitive.
※ That's indicates the organizational form (or actual state) which expressed as a Red Organization or Amber Organization.

It's hard to solve this problem because most workers have no psychological experience of these cases.
Most business owners, Managers and even Healthcare Professionals don't know what kind of mental state will be.

So Let's imagine.

  2. Joined the organization as a newcomer and completed three months of On the Job Training.
  3. Months pass from allocated to a department.
  4. The building of relationships within the organization is beginning.
  5. He spends his days hoping to rise in the organization.
  6. He got his first year salary several times.
  7. Completed all applications and registration procedures to the company and country.
  8. Some colleagues have settled into a new house contract and others cleared up their own room.
    In these days suddenly,

・He told by the person in charge about the employment system here that rehiring as a part-time after retirement procedure temporarily.
・There is a back (hidden) passbook, and superiors explained to him the outline of its operation.
・He got to know the custom of the request to issue a forged receipt to a partner company,
further he has known the difference has been spending for the company outing or internal exchange meetings.

Do you have the courage to forsake all this ?
It's almost impossible to judge by people around twenty years old.
If it's their first time working at a company, that's even more.

“Momentary and Fresh Disappointment”.

But, he is not in charge of it, so he just closes his eyes quite as if nothing had happened.
At this point he is based on his situation and environment,
hopeful observation, optimistic future view.
For example
"I don't know and care."
"It will soon come out all right."
"I'll be OK, if I won't be involved with the situation (black box) for a lifetime."
These self-confidence (the tendency to believe in himself), and
Youth (energetic motivation), that's the reason that exceeds "Minor disappointment".
He will disregard and forget as summarized by the positive expression of "fresh".

"Neglect of slight disappointment is a straight road to despair."

Because most people cannot experience this mechanism, society must know this and share information.

A few years later, he got married, had children, and was promoted, at that time he had turned away his eyes but his premonition turned out to be right, his superior appointed him to be a person in charge of fraud and illegal activities.

At this time②,
it is not necessary to hear.
There is no way to refuse this dark resignation anymore.
The sources of income, internal status, external credit,
There is no courage to throw away all of these.
Because he pretended like he didn't see any illegal activities for several years.
There is no reason for him to come out with a sound argument to the boss.
Don't forget that here he is in a state of

"self-justification paralysis".

It is not a matter that can be consulted with someone.
No one seems to be able to endure this serious content.
Furthermore, It's more impossible to say to a family that "Actually, I knew about the wrongdoing and illegal activities of the company but I was silent."
Then he may be denied personality such as "How is it as a human being ?"

He has got a tangled relationship and there is no longer any help.
This is a detailed document of psychological description of the members of the organization who (only) silently overlooked fraud and illegal activities.

When he will disclose all guilt, will take a load off his mind.

Well, where did he stop that ?
It's just only "At this time①", in short only when he felt "a momentary and fresh disappointment".

But as I mentioned earlier, most of the new recruits are around 20 years old, so It's hard to submit a resignation and tell the superior rightness of his insistence fluently.

But, due to years of accumulation, there is no responsible person, and the guilt of conscience of each relevant person is generally low, it usually ends with the claim that all of them are victims.

A corporate model that I recommend is
・one floor size.

・The members think and act voluntarily for the organization's growth.

However, the way of saving organizations that have already grown and have many members is that there is no choice but to move and create the following laws.
※ It should not entrust with corporate judgment.

Example 1
“At this time ①”,
If new employees accuse self-company's wrong actions or illegal instructions, unlawful procedures etc., and they will retire, for next company which they will belong, the company have to issue an official document about these employee's history as an "internship", and also have to issue a letter of recommendation.
And the company has to pay compensation for three months worth of salary immediately.
Furthermore, the nation must award them the prize for stopping the next victim.

Example 2.
Nations have to work on the following establishment of rules as one of the most serious corporate crimes which illegal acts to degrade national economic motivation.

・A company that maintains a corporate culture that does not pursue self-cleaning.
・When a company hires new employees hiding fraud and illegal activities, these will be irreparable history damage for them and are linked directly to their future and despair for society.
If the motivation of young people in the nation is decreasing it is no exaggeration to say that this is the cause.
It should not handle that under civil law.

And it must not make an end of that as a crime of an individual in the organization.

In light of this relentless situation,

"A Corporate Criminal Law"

must be established for future economic development.
※ This is the only way to eliminate suicides in the organization.
※ Under the current law, It's going to be abandoned to just payment have done.
So even if the life of the members is destroyed, the way of life of the corporation will not be cured.

The company must pay money compensation to employees who accuse the company of the disclosure of fraudulent or illegal instructions and procedures, and voluntarily retire, that's "Periods Of Enrollment × of several times to several hundred times as many".

The resume rule that nations have to establish for not affecting subsequent hiring decisions
(It's an application to the corporation equivalent to civil liability of a natural person.)

By extension
・ A business suspension order to company operation (The prison sentence
for a corporation)
・ Company demolition (Death penalty for a corporation)

These are asking for the (whole) organization's responsibility.
(It's an application to the corporation equivalent to criminal liability of a natural person.)
In eradication of black corporate culture (It's Japanese term, means darkness of a company's culture.), creation of responsibility rules that are untouched for many many years and unknown are the reforms that need to be tackled first.

If there are some nations that won't tackle the above, the culture of a nation is "Dark Collective Culture" itself. (It's a Japanese term, which means darkness of a community's culture.)

Giant organizations are too ill-ventilated to ensure the human rights of individuals within an organization.

With the penetration of the above rules, It will be proven that illegal acts grow and live for many years are widespread in organizations .
※ No matter how much a company that has become too large contributes to tax payment, when company will fall into a situation that company cannot help but fire large number of member, nation will must throw a huge tax without to say anything for whole nation.

That's a donation to a private company and it is an abnormal sight.
And that's alliance and bribery that must not be forgiven
because during the procedure there are small business companies that are crushed by lack of funds.
Increasingly small, and flexible dispersion of organization has become the mainstream, explosive gains from sales numbers with monopoly will be pessimistic.
Company style that can make money will be "Intellectual property, copyright and other inventions and ideas or companies that sell high-quality products (including intangible products such as services)" only.
If reform the investment conditions of nations and banks and they work on discovering casual ideas, some companies (or persons) need a lot of capital will have plenty of opportunities that even a small businesses (for example one-man business) company can possible to get a 10 billion yen ($ 100 million) currency unit of investment.
Then gradually, young people begin to think as their own affairs, local but hopeful societies will be realized around here and there, and "The Japanese Dream" will be embodied and begin to be revealed.

※ Primarily rich ideas, careful attention, real hospitality cases where the realization of etc. is directly linked to huge money.
※ "Think daily, Execute today, and 100 million yen (million dollars) tomorrow !". Also building nations by these catchphrases may reform people's awareness or behavior by subliminal effect.
This is obvious and easy to understand, represents the vector Japan aims for, the Japanese economy should push forward this attitude.

I think this flow is better.
Japan is a small and humble nation, so competing on a capital scale and a company size field in itself ruins Japan's strong points.
Japan would better invest its own money (or credit) in local projects in multiple countries.
Accumulating many small rewards is the way of old Japanese thinking called "Sanpoh yoshi (Good for three sides)" will prove its legitimacy worldwide.
※ One of the family precepts of "Ohmi shonin (The merchants of present Osaka area) " is known to be that of "Sanpoh Yoshi", which teaches that the merchants should take into consideration of the benefits for three sides at the same time. At first it's for customers, next is for society, and the end is for the merchants themselves.

Few people want trillions yen or hundreds of billions yen in Japan.
It will be suitable as "A Japanese sized success" that the country aims for tens of millions people of the Japanese nation to be able to get 100 million yen.
The penetration of this continuous decentralized investment effort is the biggest risk hedge.
I am convinced that it will be a world-contributing business, so it will be thanked by all of the world and will not be mistaken for invasion.

実態と共にその心理描写を知らないと、
正論ばかりで解決方法はいつまでたっても見つからない。

「トップは」しれっと違法行為を希望していることを「匂わせる」。
「中間管理は」大事として部下に「絶対的権限を以って指示する」。
「末端構成員は」不正と知りながら「てんやわんやで実行する」。

トップが匂わせるだけで末端はてんやわんやで実行する・・・

これは暴力団等反社会組織、民間組織、国家組織を問わず
「人間組織に於ける長年の当たり前」である。
未だ先進国の組織構造は原始時代にある。
※ レッド組織やアンバー組織と表現される組織形態(実態)を指す。

例1)オウム真理教
トップ(麻原)がサリン散布を指示 ⇨ 死刑

中間管理者
洗脳による絶対権力に従い実行 ⇨ 死刑または無期懲役

末端構成員は知らされていなかったが、
中間管理者はその実行や構成員殺害を匂わせながら恐怖統制を維持
⇨ 組織解体

例2)民間組織A
現場ではアルバイトが幅をきかせ中間管理と仲良しで、
自身達の仕事を確保する為新人を排除しているのが実態、
アルバイトはいじめで退職へ、社員であれば中間管理と組んで遠方へ異動させ退職へ、
と追い込んでいた。
エリアマネージャーは堂々と「俺はお前を辞めさせに来た。」などと吹聴し、
その空気感を現場全体に蔓延させる等手段を選ばなかった。
遂にエリアマネージャーが暴行し警察沙汰となった。
トップは何故か被害者社員を解雇した。???

幅をきかせたアルバイト ⇨ 店舗閉鎖を機に解雇
中間管理職 ⇨ 降格
エリアマネージャー ⇨ 書類送検でクビ
ついでに社長 ⇨ 取締役会で解任
被害者本人の解雇は解除されなかった!!

例3)国家組織 Z
疑惑段階であるがこう思われても仕方がない、
というかこうだろう、という状況が以下の通り。
自責の念にかられ自殺した近畿財務局職員(赤木氏)は
公文書の改ざんを組織トップ(佐川)から指示され実行
⇨ 公務災害(労災)認定。
佐川は更なるトップ(安倍夫妻)への忖度による自己判断により
絶対的な指示を行ったとみられる。⇨ 辞職

財務省、麻生氏、安倍氏等々の意向が根本にあるとみられるが全て不問状態。

私は以下を踏まえているので赤木氏を責める気にはなれない。 が、
現状社会は絶望した(赤木氏)自身の公務員組織(国会)が
ルールを作っており、
オウムの事件に照らし合わせそのルールで裁かれるならば、
単なる実行犯で有罪である。

公務員は自身所属の組織トップがルールを創っていることを
もっと重く認識する必要がある。
普段その運用や組織腐敗に異論を唱えず、
むしろ笠に着て横暴に振りかざしている感さえある。
被害当事者となった時だけ声を上げるのは、御都合主義で実に不誠実である。
このような悲劇ですら「ざまみろ」と思われかねない。

この問題が解決出来ないのは殆どの社会人に、
「心理的経験が無い」
ことである。
どういった精神状態になるか、
殆どの経営者、管理職、ひいては医療関係者ですら知らない。

想像してみよう。
1.大々的に親御さんへの自立報告や決意表明をし、
2.新人として組織に加入して三か月の研修を修了、
3.現場に配属されて数か月。
4.組織内での人間関係構築が始まりつつあり、
5.組織を昇っていく希望を抱き日々過ごし、
6.一年目の給与を数回手にし、
7.社内や国への申請や登録手続きを全て済ませ、
8.人によっては新居の契約や片付けがやっと落ち着いた。

そんな頃突然、
・一旦退職手続き後アルバイト再雇用したことにされてしまうのが
ここの雇用システムだと担当から聞かされる。
・裏(隠し)通帳があって運用の概要が説明される。
・提携業者への偽造領収書発行依頼が習わしとなっており、
その差額が慰安旅行や内部交流会の資金となっていたことを知る。

この時 ①、

「上記8項目の、ここまでに費やした時間、ここまでに構築した人間関係、
これから得るであろう地位と金銭、親族や周囲への宣言とそれらからの期待、
これら全てを捨て去る勇気はあるか?」
若干二十歳そこそこの者の判断力では殆ど無理。
まして初めて職に就いた企業であるならば尚更だ。

「は?」とか「え?!」と思う。この

「瞬間的新鮮な失望」

を覚えておこう。が、
まぁ、自分がその担当でもないのでつい目をつぶってしまう。
この時点で自身の置かれた状況、環境を礎(いしずえ)に、
希望的観測、楽観的未来観、例えば
「よく分からないし関係ない。」
「何とかなる。」
「その状況(ブラックボックス)には生涯関わらなければいい。」
というような考えしか湧き出てこない理由があり、
「軽い失望」を、
自信(自分を選ばれし者と信じる傾向)や、
若さ(エネルギッシュなモチベーション)が上回り、
「新鮮」というポジティヴな表現に集約される軽視、忘却へと
大半が自身の中でいざなう。

「軽い失望が絶望へと続く一本道である」

など思いもよらない。
このカラクリは殆どの社会人が経験出来ないから、
情報として社会全体が知り共有せねばならない。
数年後結婚、子供が出来、昇格した上で嫌な予感が的中し、
これら目を背けてきた不正や違法行為の担当者(責任者)に任命される。

この時 ②、

聞くまでもない。もはやこの闇辞令を断る術は無い。
ここまで積み上げてきた収入源、社内的地位、対外的な信用、
これら全てを捨てる勇気などさらさら無い。
数年間もの間違法と知りながら見ぬふりをしてきたのだから、
今さら上司に偉そうな正論を吐ける訳もない。
ここでは「自己正当化麻痺」の状態に陥っていることを忘れてはならない。
もはや自身だけでは救いが無く、且つ誰かに相談出来るような案件でもなく、
この深刻な内容に堪え得ると思える相手もいない。
まして家族に
「実は会社の不正、違法行為を知っていて黙ってた。」
などと
「人としてどうなの?」
と人格否定されかねないカミングアウトを出来る訳がない。
しがらみで全く身動きが取れない、
これが当初不正や違法行為を見逃してきた「だけ」に始まった者達の
組織内構成員の心理動向である。
「ピクンッ!」
と頭の中で閃(ひらめ)きのように感じた罪悪感や正義感が、数年で
「ぼーっと、そしてべちゃーっと」
まるで身体全体に広がるように蔓延して感じる鈍感な自身の変貌に気付く。
「どこで間違ったのか・・・」
と自己反省を試みるがよく分からない。
それは組織に慣れた頃以降にそのきっかけがあったと思っているからである。
また、これまで何度か正しい道に戻れる機会があっただろう、
と思っている場合が多いがそれも大きな間違いである。
取り戻さねばならないことの総量は、
逃避を主とする時間の経過に比例しながら(時に加速度的に)増していく。
しがらみは日々一刻複雑な絡み方を促進し、
堤防に捨てられた釣り糸の如く誰一人ほどくことなど出来ず、
全てを捨てる他は無い。
あとは
自身のツケを後進に押し付けて逃げるか、
露見しないのを祈りつつ定年を迎えるか、
発覚して貰って有罪となり肩の荷が下りるか、
を待つばかりである。

さて、ではどこで踏みとどまれたのだろう?
「この時 ①」だけである。

この「瞬間的新鮮な失望」を感じた一瞬しかない。

このタイミングを逃したら、取り返す機会は二度と訪れないのである。
しかし先に述べた通り若干二十歳そこそこが大半の
新入社員が能弁に正論を吐き堂々と辞表を叩きつけることは
ほぼ不可能に近い。
それだけに若者達の人生設計を狂わすレールを敷いた
組織(企業)の責任はとてつもなく重い。が、
長年の蓄積で責任者不在の為各々加担した者達の良心の呵責は総じて低く、
総被害者主張となりうやむやで終わるのが常である。

私は
ワンフロアーサイズで、
クレド(理念)が統率し、
それに向け自発的に構成員が考え行動する
企業モデルを推奨しているが、
既に大きくなってしまった組織、
その構成員を救う手立ては国が動き次のような法律を創設するしか無い。
※ 企業判断に任せてはならない。

例1.
「この時 ①」のタイミングで不正や違法な指示、手続き等の発覚
を以って告発し自主退職した場合、
企業はこの社員の履歴を「インターンシップ」とし、
推薦状を公文書として発行すると共に、
3ヶ月を上限とする直近額での給与補償を義務付ける。
更に国家は、この告発を次の犠牲者を食い止めた功績として表彰する。

例2.
国家は国家経済モチベーションを下落させる
最も重大な企業犯罪の一つとして、
自浄に取り組まない企業文化維持企業、
不正や違法行為を隠しての新規採用企業、
これらが新入社員の生涯取り返せない履歴損害、
ひいては自身の将来や社会への絶望と直結しており、
若者達に蔓延するモチベーション低下傾向は
ここに起因していると言っても過言ではない。

民法で処理してはならない。
組織内個人の犯罪として処理してはならない。

という暗躍する実態を踏まえ、もはや 今後の経済発展には

「法人刑法」

を創設せねばならない。
※ これこそが組織内自殺者を無くす唯一の方法である。
※ 現行法では金を払えば終わり。
だから構成員の人生を潰しても法人の生き方は治らない。

不正や違法な指示、手続き等の発覚を以って告発し自主退職した社員に対し、
在籍期間 × 数倍~数百倍程度の金銭補償や、
以降の採用判断に影響させない履歴ルール構築
(対自然人民事責任相当の法人摘要)、ひいては
・企業運営停止命令(法人格の懲役刑)
・企業強制解体(法人格の死刑)
等組織(全体)責任を問う(対自然人刑事責任の法人摘要)ルール創りが、
長年はびこってきた責任所在不明なブラック企業文化撲滅に於いて、
先ず最初に取り組むべき改革である。

組織内に於ける個人の人権を確保するには巨大化組織は風通しが悪過ぎる。
上記ルールの浸透により、如何に組織が巨大化したまま長年生きながらえると不正が蔓延するかが証明される。

巨大化し過ぎたマンモス企業がどれだけ納税貢献しても、
ひとたび大量の解雇者を出す、
或いは破綻するような事態に陥った時、
有無を言わさず巨額な税金を投じて一民間企業に寄付することになり、
その手続き中にも資金不足で潰れていく弱小企業があることを鑑みると、
如何にも異常な光景であり、絶対に許してはならない癒着、収賄である。
次第に小サイズで小回りや融通が利く組織分散が主流となり、
独占を初めとする販売数による爆益は望めなくなる。

稼ぐのは、

「知的財産、著作権を初めとする発明やアイデアと
(サービス等無形商材を含む)高品質商材を売る企業」

だけとなる。
巨額な資本が必要な場合は、国家や銀行の投資条件の改革、
カジュアルなアイデアの発掘機会により
小規模企業に於いても百億単位の出資が可能にしていくことで、

「ジャパニーズドリーム」

主に発想の豊かさ、きめ細かなこだわり、おもてなし等の具現化が
巨大マネーと直結する事例。

「日々考え、今日実行、明日一億円!」
というようなキャッチフレーズ国創りも
復唱サブリミナル効果による意識改革により
国民全体の言動成果が期待出来てよし。
この露骨で分かり易いことこそ日本の目指すベクトルを端的に表しており、
こうした姿勢を日本経済は前面に押し出すべきである。

のモデルケースを積み重ねていく。
次第に若年層にも当事者意識として、
「ジャパニーズドリーム」実現に希望を持てる社会が具現化、露呈し始める。
この流れがベターと考えている。
日本という小規模でつつましい国民性の国家が海外資本と
企業サイズで勝負する土俵に上がること自体、
日本のストロングポイントを潰している。
日本は巨大(信用)マネーを所持しつつ、
ニッチに多国へのローカル案件投資を行い、
小規模な見返りを広く数多く積み重ねることこそ日本古来の

「三方良し」

先ずお客様に良し、次に地域社会に良し、最期に店舗(会社)に良し、
が揃って初めて商売は根付くという近江商人に起源を発する考え方。

の正当性を世界中で証明することとなり、
何兆や何千億など欲する国民が殆どいない日本サイズの成功であり、
一億円を何千万人が保有する国を目指した方が良い。
この継続的分散型投資努力の浸透こそ
経済恐慌に対する最大のリスクヘッジであり、
他国が真似できず、感謝こそされ、
間違っても侵略などとは誤解されない世界貢献商売であると確信している。
