(b) A witness or possible witness in an "official proceeding" commits offense if they knowingly benefit by representing or understanding they will.

SEC 37.04. MATERIALITY
(a) Statement is material, regardless of the admissibility under rules of evidence.
(b)It is no defense to mistakenly believe to believe the statement is immaterial (Aggravated Perjury)
(c) Whether a statement is material is a question of law to be decided.
