French Family Fighting for Justice After Gardasil Vaccine Injury

The story of Marie-Océane is a shocking one that tells about the potential dangers a vaccine can impose on a young persons life. When everything is going great and all of your life is still ahead of you, a simple vaccine recommended by your trusted doctor can send your life crashing into pieces where you can't get back what you lost. Marie-Océane's parents told the story of what happened in their family, hoping to prevent anyone else from going through the same hardship due to not knowing about the potential risks.

Marie-Océane Bourguignon was 15 when she went to the doctor for a medical certificate. The doctor recommended the Gardasil HPV vaccine yo prevent cervical cancer. Trusting the doctor, the parents Jean-Jacques and Yveline Bourguignon accepted the recommendation and consented to the vaccination.

Two Gardasil vaccines were administered approximately 2 months apart in 2010 (October and December). But even before receiving the second injection,Marie-Océane was experiencing sensory and motor problems in her upper limbs just two weeks after the first vaccination. The symptoms regressed over a two-week period, with the parents thinking the tingling and loss of balance were just part of normal adolescence and had nothing to do with the vaccine.

But two months after the second injection Marie-Océane vomited and experienced severe dizziness. One month after that she was hospitalized for deterioration in her general health. She had cerebral-vestibular disturbances and sensory-motor impairment. Two days later MRI showed lesions in the way matter of her brain. March 2011 was the beginning of the dark times for the Bourguignon family. The parents were constantly traveling to the hospital and back home, with Marie-Océane experiencing devastating attacks one day, while appearing fine and in good health the evening before.

Marie-Océane had a stroke that left her in a wheelchair along with a loss in vision and hearing from acute encephalomyelitis (inflammation of the brain). Her severe problems of being wheelchair bound, having facial paralysis, dizziness and fatigue went on for 2 years, leaving her unable to attend school. Her mother refused to leave her alone in the poor physical and moral state she was in, so she quit her job to take care of her daughter. The parents didn't know if Marie-Océane would survive, living in fear that they would lose their "precious pearl" at any time.

Doctors didn't know exactly what the problem was, as they first thought Marie was suffering from either multiple sclerosis for acute disseminated encephalomyelitis (ADEM). After longer hospitalization, the determined it was multiple sclerosis, which is a progressive disease that involves damage to the sheathes of nerve cells in the brain and spinal cord. The symptoms from his disease include numbness, impairment of speech, poor muscular coordination, blurred vision and severe fatigue.

There is no cure for multiple sclerosis, but the parents still felt lucky despite the doctors taking two years to make a firm diagnosis because at least they know what it was now. They were also sure that the encephalomyelitis was a result of the HPV vaccinations as the doctors pointed out the link between the time of the night is so vaccines and the development of symptoms.

An expert from the Regional Commission for Medical Accidents in Aquitaine concluded pathology was consistent with vaccine injury. But, because the father had type II diabetes at age 50, this could have been underlying genetic susceptibility for the development of the pathology. In January 2012, parents filed for compensation with the Regional Commission for Conciliation and Compensation (equivalent of the Vaccine Injury Compensation Program court in the United States), Regional Medical Injury Arbitration and Compensation Tribunal in Bordeaux.

Over a year later in September 2013, the judge made a decision whih stated that the two Gardasil vaccines were 50% responsible for the permanent injury of Marie-Océane, while the other 50% was due to a generic predisposition for autoimmune disorders that allegedly came from the father due to him having type II diabetes.

The sellers of Gardasil in France, Sanofi, made a compensation proposal to the parents, which if accepted would reject any accountability for the injury despite the court ruling and two medical reports saying otherwise. Sanofi's attempted a settlement agreement was a complete denial of their responsibility as they tried to shift the blame to the parents as allegedly being anti-vaccine, when they weren't.

The Bourguignon family could not accept the compensation to move on with their lives. They knew they weren't the only family to suffer under Gardasil vaccine injuries. If they accepted, the warning to other families about the risks of vaccine injury from HPV vaccines would go unnoticed. If they accepted the compensation from Sanofi, only they would benefit, while countless others might suffer the same fate.

Instead, they took their case to traditional court where the outcome of the trial would be made public, with more people potentially learning about the risks of the HPV vaccine. They wanted justice for everyone, not just for themselves. The opportunity to make the public aware and warn others of the fact that HPV vaccines can be this dangerous was more important to them than getting paid off to keep silent.

700 families in France had daughter who already suffered from HPV vaccine injuries. The Bourguignon family believe the health authorities have hidden or minimized the damage being caused by Gardasil. In 2013, on behalf of the Bourguignon and 50 other families, their attorney filed a criminal complaint against Sanofi Pasteur and the French Medicines Agency.

After 2 years, they found out the Paris public prosecutor’s office had buried the case, stating there was no direct link between Garda so and the pathologies of the nervous system experienced by the many girls in the complaint. None of the 50 families were consulted for this public prosecutor to arrive at this conclusion. None of the families were ever told the case was closed. It was pure ignorance of evidence and collusion with the industry to favor the holy grail image of vaccine safeness.

All these families want is open and honest scientific debate about the safety of the vaccine. They filed an appeal and a civil proceeding with the Dean of Investigating Judges in Paris to try to get justice again. The families were summoned only once since, and feel that no one in the legal system wants to open this can of worms. In February 2018, a new complaint was filed, this time with the civil court Dax, asking for damages from Sanofi.

Marie–Océane, now 22 years old, is still trying to rebuilt her life after she lost most of her teenage years and opportunity to build a future early on. She couldn't pursue her career in architecture at age 20, instead going into cooking. She passed her pastry chef CAP and wants to create her own business selling artisan pastries and local products. Due to her chronic illness, she can't work for a boss, and will be her own boss instead so that she can work at her own pace.

The Bourguignon keeps on fighting for themselves and for other families who still suffer with children being injured, and children having lost their lives due to Gardasil vaccine injury. They want to get justice for the sacrifices that many have made by blindly trusting their doctor's advice.

It's a tragedy that so many families get injured by the vaccine, and yet the courts don't provide justice to them or to the rest of the citizenry who blindly trust that the courts and medical professionals are doing their job to keep the people safe. We have fraudulent systems in place across the world that most people blindly trust in. If more people knew about these issues, less people would be falling victim to the harm being imposed upon them. I hope the Bourguignon family can finally get some justice and warn others with this 4th attempt through the courts.
