The outrage machine over the FGM ruling is wildly misrepresenting the decision. All sorts of things that are obviously crimes don’t fall within federal jurisdiction. They can be, and are, prohibited at the state level. The court didn’t hold that FGM can’t be banned or that it’s some sort of constitutional right, it held that it’s not Congress’s job to ban it because it has nothing to do with interstate commerce or other enumerated federal powers.
There’s also no general federal law against murder, but that doesn’t mean murdering people is a constitutional right. It just means it’s up to the states to prohibit and punish murder.
One of the annoying aspects of the reaction to this case is all the people (including many conservatives, who especially should know better) acting as if this federal law is all that stands between us and some vast epidemic of FGM. In reality, FGM is illegal under state law in every state and this is the first prosecution ever brought under the federal law since it was passed in 1996. No reason to think states cannot handle this issue.
